- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 08, West Palm Beach, Florida, Medical Center. 2.Description of Action: Describe the action being reviewed and approved. This is a request for other than full and open competition for the procurement of construction service to replace expansion joints at the parking garage located at the VA Medical Center, West Palm Beach, Florida. This is being set aside a sole source to Veterans Development Corporation, a Service Disable Veteran Owned Small Business (SDVOSB). 3.Description of Supplies or Services: Project 548-10-102. The contractor shall replace approximately 1500 linear feet of expansion joints located both between the parking garage and main hospital building as well as between different free floating sections of the parking garage. The locations of joints to be replaced are shown on the contract drawings. The new joint materials shall be of the poured type joint sealer with backer rod and shall meet the requirements of the Florida Department of Transportation design standards, index no. 21110 and Florida Department of Transportation specification section 932-1.2. The contractor shall remove all existing joint materials, not merely to the necessary depth required for the installation of the new product, but all the way through the joint from top to bottom. The estimated period of performance is 90 days. The contractor shall maintain access to the hospital at all times and follow applicable FDOT requirements for traffic control. All actual site work shall be done between 5 PM Friday evenings and 7 PM Sunday evenings. The contractor shall provide the Contracting Officer with at least 48 hours notice of all site work. 4.Statutory Authority: (FAR Subpart 6.3-Other Than Full and Open Competition). ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Validity of Use of Statutory Authority: Statutory authority used in this acquisition is Public Law 109-461, section 502, 8127 which states Sole Source Contracts for Contracts Above Simplified Acquisition Threshold- For purposes of meeting the goals under subsection (a), and in accordance with this section, a contracting officer of the Department may award a contract to a small business concern owned and controlled by veterans using procedures other than competitive procedures if-- (1) such concern is determined to be a responsible source with respect to performance of such contract opportunity; (2) the anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C. 403)) but will not exceed $5,000,000; and (3) in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers best value to the United States. Veterans Development Corporation is a SDVOSB with a high degree of experience and has a proven past performance record at the West Palm Beach Medical Center. Therefore, this acquisition is set aside to Veterans Development Corporation as a sole source under the referenced statutory authority. 6.Actions to Promote Competition: Use of other than full and open competition is authorized by FAR 6.302-5 and statutory authority; Public Law 109-461, section 502, 8127. 7.Determination of Fair and Reasonable Price: The contracting Officer determines the anticipated cost will be fair and reasonable based on the results of market research and performing an analysis of the government's independent estimate. 8.Market Survey (FAR 10): Market research indicated various SDVOSB companies could fulfill this requirement. However, Veteran Development Corporation has a high degree of experience in construction and has proven past performance record at the West Palm Beach Medical Center. 9.Other Considerations: None 10.Listing of Sources that expressed, in writing, an interest in the acquisition: None 11.Statement of Actions to Overcome Barriers to Competition: Continued market research in this area will be performed to establish a more competitive procurement environment. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
