TRADUZIONE AVVISO DI GARA/TRANSLATION OF COMBINED SYNOPSIS SOLICITATION NOTICE The purpose of this notice/solicitation is to competitively issue an undetermined number of Basic Ordering Agreements (BOA) for various types of Multi Trade Construction projects to include design to build construction at Aviano and Ghedi Air Bases, Italy. The proposed Basic Ordering Agreement is included in this notice. A basic ordering agreement is not a contract. Each order issued shall be subject to the contract clauses, provisions, certifications, terms, conditions and pricing of the BOA. Firms issued a BOA may receive requests for technical and/or price proposals leading to award of orders. Issuance of Basic Ordering Agreements will be based on evaluation of qualifications in accordance with the criteria as set forth below. Award of specific orders as requirements arise will be based on price and other factors as deemed desirable and set forth for each specific requirement. Specific Firm Fixed Price orders will be competed among those firms issued a BOA. The Government, in its sole discretion, will determine which, and how many, of the firms holding BOA's will be requested to submit price and technical proposals for requirements leading to Firm Fixed Price orders. The approximate range in value of orders is expected to be $650.00 to $1,500,000.00 (Euro 500.00 to Euro 1,160,550.00). The foreseen average number of orders per year is 19 for an approximate aggregate value range between $8 million and $15 million (Euro 7,737,000.00 and Euro 11,605,000.00). The majority of projects have been for vertical multi trade construction efforts. Under this Multi Trade Construction program, firms selected for a BOA will compete on task orders for requirements. If adequate competition cannot be obtained, the Government reserves the right to open the area of competition to include non BOA holders. There is no guaranteed minimum dollar amount or volume of work that will be ordered under the agreement. Government funds are obligated only to the extent that a duly issued order creates such obligation. Pricing: In order to provide maximum flexibility for market conditions, economies of scale and quantity considerations and other price driving factors, firms will be required to submit Not to Exceed coefficients for each year of the anticipated 5 year duration of the BOA. Each order under the BOA shall be on a Firm Fixed Price basis. The order proposal cannot be based on prices that exceed the ceiling coefficient for the applicable period. The Contracting Officer will open/advertise the BOA program through the Federal Business Opportunities website (http://www.fbo.gov) for new entrants once a year or at intervals that will guarantee adequate competition for this specific Multi Trade Construction program. The BOA can only be changed by modification of the agreement itself and not by individual orders issued under the BOA. Modification of the BOA shall not retroactively affect orders issued prior to the time of the modification. A BOA may be cancelled by either party by mailing or otherwise transmitting 30 days prior written notice to the other party. Any such cancellation shall have no effect on any orders issued prior to the effective date of the cancellation, which shall be 30 days from the date of mailing or otherwise transmitting the written notice of cancellation. Prior to the effective date of cancellation, the 31st Contracting squadron may continue to place orders under the BOA. Firms that demonstrate that they meet the following qualifications will be considered for issuance of a BOA. Approximately five (5) BOA's will be issued to the most qualified firms for each of the classifications listed below. Firms selected for each classification may participate in order solicitations at or below their classification level, but not for higher classifications. Upon submission of the following information, the Government will review the documents and each firm will be determined to be either eligible or ineligible. To qualify for receipt of a BOA, each firm must submit the coefficient pricing schedule, list of references and documents that meet all the following minimum criteria for each SOA classification:(NOTE: For Items 1, 2, 3, and 4, European Common Market firms established outside of the Republic of Italy shall present their Government's corresponding documents with an English translation of each document1. Host Nation Documentation Requirements) 1. Inasmuch as the work of this solicitation is to be performed on land provided the US Armed Forces stationed in Italy by the Italian Ministry of Defense (MOD-IT), the Offeror, Joint Venture Members and Partners to a teaming arrangement shall submit the following documentation with their offer: a. DPR 554/99 Article 75 as cited in DPR 412/00 article 2: (1) DPR 554/99 Art. 75. The requirements of Item 1 letters a), d), e), f) and g) can be in the form of self certification. (2) DPR 554/99 Art 75 The documents of Item 1 letters b) and c), "Certificato d'Iscrizione al Casellario Giudiziale" and "Certificato dei Carichi Pendenti" must be documents no older than 6 months from the date of the solicitations and cannot be substituted by self - certification. b. Law 575, 31 May 1965, article 10 as implemented by DPR 252 of 3 Jun 1998 (Antimafia law). This law can be met by providing an original unexpired Certificate of Enrollment with the Chamber of Commerce bearing the required "Nulla Osta" (No Impediment) statement. 1. 2. The self certifications and certification of 1.2.1.a (1) and (2) are required to be included in the offers. An Offeror must either submit its Chamber of Commerce certificate and statement with its offer, or within the time frame established by the Contracting Officer. The Government may not make award of the contract prior to receipt of the subject documentation. Failure to comply with the above requirements will be cause for rejection and non consideration of offers or denial of award in case of 1.1b above. NOTE: European Union firms or subcontractors established outside of the Republic of Italy shall present their proposal documents, including their Government's corresponding documents, with an English translation of each document. Any self certifications provided by other than Italian firms shall have been notarized. 2. DURC document issued by Italian authorities or equivalent document issued by member nation of the European Union. The DURC document shall be submitted for direct hire employees as well as any self employed person and subcontractors. This document must not be older than 90 days from date of contractor proposal. 3. Copy of SOA for Category OG1 for the Classifications that follow. The greater the number of additional categories and higher classification for each of the additional categories the higher the qualification consideration for the specific Category. a. Classification I b. Classification II. c. Classification III d Classification IV e. Classification V 4. List of Multi Trade Construction work performed over the last 3 years from date of closing of this solicitation. This list shall include a description of work performed, the client name, address and POC information, amount of the contract, date work initiated and date completed. Note: The greater the number of different types of trades performed the higher the qualification consideration. 5. Satisfactory Past performance rating. Interested firms shall submit information references on the attached form for at least 3 different clients for work performed over the last 3 years. The Contracting Officer reserves the right to contact clients to obtain past performance information and rating as well as to obtain such information from other commercial or U.S. Government sources such as PPIRS, CCASS and CPARS. The better the past performance rating the greater the qualification consideration. Required documentation to be submitted by the closing date: 20 May 2010, 17.00 hrs (5:00PM) CEDST.
