Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, North Branch, VA Puget Sound Healthcare System, 9600 Veterans Drive, Tacoma, WA 98493 2.Description of Action: This is a justification for other than full and open competition for the procurement of Service Agreement to maintain and service two BV Pulsera C-Arms (also known as fluoroscopes or portable X-ray machines) for the Research and Development Office for the Department of Veterans Affairs VA Puget Sound Healthcare System (VAPSHCS). This is a sole source per FAR 6.302-1 “ Only one responsible source and no other supplies or service will satisfy agency requirements. The use of a particular vendor is required to service the robotic C-Arms that were acquired under R&D contract SPM200-02-D-8321 ensuring consistency in research studies. 3.Description of Supplies or Services: VAPSHCS has a requirement for service and maintenance of two BV Pulsera C-Arms. The RR&D Center of Excellence for Limb Loss Prevention and Prosthetic Engineering has recently purchased two BV Pulsera C-arms (i.e., fluoroscopes or portable X-ray machines). The RR&D Department is currently in the process of taking the C-arms apart and constructing a custom designed biplane fluoroscope. They will be one of about five laboratories in the country with the ability to use a biplane fluoroscope to study the internal motion of bones. The current warrantee on the C-arms expires in May of 2010. This service agreement will allow us to have Philips Medical Systems provide service and routine maintenance to the C-arms. The vendor is required to provide customer services on the robotic C-Arms located at 1660 South Columbian Way, Bldg 13, Room 105, Seattle, WA 98108. The equipment quality performance assurance service as scheduled by Philips will include a general system inspection and review of system operation, calibrating the system as necessary, system lubrication and filter replacement or cleaning, completing minor operational and reliability field engineering change notices or updates and other remedial maintenance of a non-emergency nature. Philips will provide such planned maintenance during the Service Coverage hours at a time that is mutually agreed upon. The estimated cost for these services is $42,720.00 for a period of performance of 14 May 2010 through 30 April 2014. 4.Statutory Authority: FAR 6.302-1 “ Only one responsible source and no other supplies or service will satisfy agency requirements 5.Validity of Use of Statutory Authority: Philips Medical Systems is the only contractor providing this technology with the specifications needed. In addition, Philips Medical Systems is working with the RR&D Center to modify the two C-arms to develop the biplane system. 6.Actions to Promote Competition: In the future, the contracting specialist will conduct market research for any new vendors that offer these services. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $42,346. The base year will cost $10,306.78 (~$890 per month). Each of three option years will be at the same cost per month. This is a unique piece of equipment that has been modified to meet our specifications. As per past service contracts for similar equipment from other companies (e.g., MTS), this has been determined fair and reasonable. 8.Market Survey (FAR 10): In accordance with FAR Part 10, market research was performed. 9.Other Considerations: Unique source “ vendor is sole manufacturer and distributor of product purchased that will be in need of service. There are no other authorized vendors who can service this equipment made with the technology and the specifications for our needs. See attached sole source. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: None. 11.Statement of Actions to Overcome Barriers to Competition: Due to the unique nature of service required this sole source is necessary. However, prior to making another sole source award to this vendor, the contracting specialist will research the market through the GSA E-Buy and Fed Biz Ops to ensure no other vendors can offer these services. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bona fide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. 13.Approvals in accordance with FAR 6.304 Contracting Officer's Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. //Signed// __________________ Deborah F.
