JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Transaction # or Purchase Order #. 523-9-2-4500-0448 2Identification of the agency and the contracting activity V.A MEDICAL CENTER, BOSTON, MA. (SUPPLY OFFICE) 3Nature and/or description of the action being approved. SOLE SOURCE PROCUREMENT FOR REPAIRS TO CARDIAC CATHERIZATION LAB AT THE WEST ROXBURY CAMPUS. THIS INVOLVES AN X-RAY TUBE REPLACEMENT AND SUBSEQUENT CALIBRATION. 4Description of the supplies or services required meeting the agency ™s needs (including the estimated value). TO PROVIDE PARTS FOR THE SIEMENS XRAY TUBE PART NUMBER 5765222 LOCATED AT THE WEST ROXBURY CAMPUS. 5Identification of the statutory authority permitting other than full and open competition. FAR PART 6.302 - ONLY ONE RESPONSIBLE SOURCE. 6Demonstration that the proposed contractor ™s unique qualifications or the nature of the acquisition requires use of the authority cited. SIEMENS MEDICAL SOLUTIONS IS THE ORIGINAL EQUIPMENT MANUFACTUER AND IS THE SOLE PRODUCER OF CURRENT PRODUCTS, SOFTWARE AND X-RAY TUBES FOR THIS MODEL. 7Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Commerce Business Daily notice was or will be publicized as required by subpart 5.2 (copy attached) and, if not, which exception under 5.202 applies. SIEMENS MEDICAL SOLUTIONS IS THE ONLY RESPONSIBLE SOURCE FOR CURRENT PROPRIETARY PARTS, TRAINING AND TECHINICAL ADVICE ON THEIR PROPRIETARY EQUIPMENT. THE PROPOSED CONTRACT ACTION IS MADE UNDER THE CONDITIONS DESCRIBED IN FAR 6.302-2 AND IS NOTED AS AN EXCEPTION UNDER FAR 5.202 (2). 8Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable. In accordance with FAR 13.106-3(a)(2) it has been determined that price of $83,183.00 is determined fair and reasonable due to negotiations with Siemens which resulted in substantial discounts. The current list price for the x-ray tube is $132,605.00. Through negotiations, Siemens has agreed to a $27,671.00 reduction for a purchase price of $104,934.00. Further, Siemens has also agreed to an additional discount with the exchange of the existing x-ray tube for a final price of $83,183.00. HE PRICE PROPOSED BY SIEMENS IS DEEMED FAIR AND REASONABLE, GIVEN THE DISCOUNTS DESCRIBED IN THE PRECEEDING PARAGRAPH. 9Description of the market survey conducted (i.e., names of firms and the date(s) the firms were contacted) and the results or a statement of the reasons a market survey was not conducted. THE COMPANY IS THE ONLY SOURCE FOR CURRENT PROPRIETARY PARTS, TRAINING AND TECHINICAL ADVICE FOR THEIR PROPRIETARY EQUIPMENT. RESEARCH WAS DONE IN GSA ADVANTAGE TO SEE IF THIS PIECE OF EQUIPMENT WAS AVAILABLE WITH GSA SCHEDULE PRICING. IT HAS BEEN DETERMINED THAT THERE IS CURRENTLY NO GSA SCHEDULE CONTRACT FOR THIS SOURCE CODE (65 II A AND 65 V A) WITH SIEMENS. 10Any other facts supporting the use of other than full and open competition, such as an explanation why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. THE COMPANY IS THE ONLY SOURCE FOR CURRENT PROPRIETARY PARTS, TRAINING AND TECHINICAL ADVICE FOR THEIR PROPRIETARY EQUIPMENT. 11A listing of the sources, if any that expressed, in writing, an interest in the acquisition. NONE 12A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. THERE IS NO OTHER RESPONSIBLE SOURCE AVAILABLE WHO CAN PROVIDE THIS PART AND FOR THE CARDIAC CATH LAB X-RAY. SIEMENS IS THE ONLY RESPONSIBLE SOURCE THAT CAN SUPPLY REPLACEMENT PARTS FOR THIS PIECE OF EQUIPMENT. I hereby certify that the data provided herein is complete and accurate to support other than full and open competition.
