The United States Government, represented by the Department of State, is seeking proposals (OF 612’s) from U.S. citizens interested in providing the PSC services described in the attached. Submissions shall be in accordance with the attached information at the place and time specified. JOB DESCRIPTION: See below U.S. Personal Services Contract American Embassy La Paz, Bolivia Narcotics Affairs Section Senior Law Enforcement and Justice Program Manager and Advisor General Statement of the Purpose of this Contract and Responsibilities of the Contractor The primary purpose of this Personal Services Contract is to secure service of a Senior Law Enforcement and Justice Program Manager and Advisor who will develop, implement and supervise USG/NAS programs that improve the capacity of the Government of Bolivia (GOB) Justice & Public Ministry, the Bolivian National Police’s (BNP) counternarcotics police Fuerza Especial de Lucha Contra el Narcotrafico, (FELCN) and the Fuerza Especial de Lucha Contra el Crimen (FELCC) to respond to the threat of drug trafficking, and other forms of transnational crime, including trafficking in persons and terrorism. The contractor will serve as the senior advisor for Law Enforcement and Justice to the NAS Director, the GOB’s Public Ministry/ Attorney General’s office and the BNP command develop and implement recommendations for management reform and providing technical assistance to GOB agencies. The Contractor will be responsible for program management services including project planning, design, development, implementation, budgeting evaluation and supervision of seven NAS projects with a combined budget in FY07 of $5.6 million. These projects would include the Law Enforcement Development (LEDP) project, the Office of Professional Responsibility (OPR) project, the Prosecutors Program, the counternarcotics training school (GARRAS) project, the Financial Investigation Unit (FIU) Project, the Trafficking In persons (TIPS) Project, and the Asset seizure/forfeiture (DIRCABI) Project. The program manager will independently conduct cross-organizational and cross-sectoral negotiations and evaluations of programs, including coordination with regional Drug Enforcement Administration (DEA) representatives, the Military Group (MILGRP) and other agencies and mission sections with operational interest or involvement in these programs. The senior advisor/program manager will report to the NAS Deputy Director, oversee the work of five NAS LES employees, a satellite NAS office at the Bolivian National Police training Academy (ANAPOL), five BNP staff instructors and be responsible for the training of approximately 3000 GOB personnel and others annually. A.Description of work Major Duties and Responsibilities: 1.Advising: Provide advice on the strategic, planning and policy implementation level with senior and mid-level Bolivian Government officials as well as Embassy elements to ensure continued progress toward CN goals established in the Mission Strategic Plan and the Letter of Agreement with the GOB. Serve as lead policy advisor and expert in the areas of law enforcement training and justice reforms. Analyze US CN policy vis-à-vis Bolivia and present to NAS Management strategies to adjust or reformulate those policies or efforts in these areas. Additionally, provides critical analysis and recommendations with suggested tactical approaches to USG CN team in Bolivia and Washington on suggested directions and responses of the USG within a highly difficult and volatile socio-political context. Attend Embassy law enforcement meetings; brief the Chief of Mission, DCM, other appropriate Country Team members, or State Department, Congressional and other visiting USG officials. Provide written reporting on major law enforcement issues, and Administration of justice issues, including the status of police reform, police/community relations, violent crime reduction and other rule of law efforts. Provide NAS Director, Deputy Director and Country Team with program advice on related issues such as improving BNP and Public Ministry personnel to meet counternarcotics and counter-crime goals and objectives. 2.Training: Establish and prepare a program of over 35 specialized basic and advanced training courses per year that will continue to develop the capacity and promote institutional building of the Bolivian National Police (BNP) FELCN and FELCC units in basic and advanced investigative techniques. Conduct analysis of the BNP FELCN and FELCC Units to further develop and implement training and technical assistance strategies for the GOB to further enhance police reforms. Provide technical assistance to the FELCN and FELCC Commanders and the Director of the Garr as de Valor counternarcotics training school in continuing improvement of its international and national CN training courses to better enable the police officers in combating nacre trafficking and other forms of transnational crime. Work closely with the BNP National Director of Training in providing assistance and advice regarding the development of a National Police Training Program and work with the Director of the National Police Training Academy to support the Officer Cadet Training Program in Bolivia. Develop and implement a National Training Program for the Public Ministry Prosecutors and Judges. Provide advice and assistance to the National prosecutor training Academy in developing and implementing a GOB National Training Prosecutor Programs. Work with the Attorney general’s office and other related Ministries to prepare new and/or modify legislation that will better equip the Police and prosecutors office with the tools they need to investigate and prosecute individuals and criminal organizations involved in narco-trafficking and other related offenses. Develop and implement a national Victim/Witness Assistance Program in conjunction with the Bolivian national Police and GOB Attorney generals Office. 3. Anticorruption and Internal Police Reform: Provide advice and technical assistance to the BNP Commander and GOB in the developing and implementation of a revised Police Organic Law that is consistent with the Code of Criminal Procedures, rule of law and international practice. Assist the BNP and FELCN Commanders in training to improve internal investigative units in the Direction National de Responsibilidad Profesional (DNRP) and related tribunals that conduct internal investigations and promote greater integrity in police activity. Provide advice and assistance to the GOB, BNP and FELCN in modernizing police management and integrating community policing and improved police/community relations policies into the GOB's administration of justice plan in close coordination with USAID’s Democracy and Governance Program. Continue the development and implementation of a National Polygraph Examiner Program in both the BNP and Public Ministry Inspector General Offices. 4. Advisory Services to the Host Government: Provide advice and assistance to the BNP/FELCN that improves police administration and resource management, strengthens internal discipline procedures and modernizes investigative and forensic functions, including policies and procedures. Provide advice and assistance to GOB officials, the BNP, NGOs and other relevant entities on establishing and maintaining mechanisms for dealing with trafficking in persons (TIP). Receive and analyze reports of BNP/FELCN and FELCC forces working for NAS-supported projects and advise the NAS Director on policies to increase productivity of BNP/FELCN & FELCC personnel. Provide advice and assistance to the Public Ministry, Attorney General and the nine District Attorney’s offices in Bolivia to enhance their institutional capabilities in the investigation and prosecution of criminal activities and organizations. Provide advice and assistance to the BNP Commander to establish a donor coordination system led by the GOB to provide oversight and rationality to assistance efforts. 5. Project Management: Serve as the Embassy's principal Police and Administration of Justice Project Manager for seven NAS-supported projects: the Law Enforcement Development Program (LEDP) project; the Office of Professional Responsibility (OPR) project; the counternarcotics training school (GARRAS) project; the National Prosecutor Program Project; the Financial Investigative Unit (FIU)Project; the Trafficking in Persons (TIPS) Project; and the National Asset Seizure/Forfeiture (DIRCABI) Project. Plan and develop overall program goals and objectives, including the gathering of requirements, design, and implementation, while monitoring and reporting on significant developments; evaluate programs’ effectiveness and efficiency and make necessary adjustments. Develop and implement a National Trafficking in Persons program; coordinate all NAS-sponsored programs with Regional Partners; Develop, and implement adequate management controls for an annual project budget totaling over $5.6 million in FY07. Schedule internal audits for end-user monitoring. Maintain liaison with all GOB and Embassy officials relevant to the implementation of these projects, representing NAS in the field and at national and international meetings, including donor law enforcement meetings, conferences and seminars. Incumbent's recommendations may influence the direction of USG policy and support with respect to police training and reform. B.Relationships to cooperating country and U.S. Embassy officials: The Contractor works under the direct supervision of the NAS Deputy Director for program matters and under the indirect supervision of the NAS Director for policy issues and the NAS Management Officer for administrative matters. The Chief of Procurement shall act as the Contracting Officer's Representative (COR). The Contractor both directly supervises five NAS LES employees, a satellite NAS training office at the National Police training academy with four BNP Staff Instructors, and has indirect responsibility for the training of approximately 3000 GOB police and other participants per year in the seven NAS-supported projects he supervises. Has frequent contact with Bolivian officials at the national level to include the National Police Commander, other unit commanders at the General rank level; Attorney General and other GOB officials, along with BNP Colonels and below in order to conduct briefings or coordinate policy and program activities. The Contract Administrator in INL in Washington shall be the Contracting Officer, INL/RM/MS. The COR is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor's performance under the contract, including acceptance of progress reports, when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at regular intervals. In no instance, however, shall the COR be authorized to alter or modify the specifications or the Contract terms and conditions or waive the Government's requirements, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, by the Contracting Officer. C.Reports, requirements & distribution The contractor shall prepare regular reports concerning the status of each project and shall include significant events and outline any problems, submitting these reports to the NAS Deputy Director. The Contractor shall make additional oral and written reports to the NAS Director and Deputy Director as required. The contractor shall prepare a Completion of Assignment Report which shall be a comprehensive review of the projects in which the contractor was involved. The report shall include a critique of and recommendations for the projects. The Completion of Assignment Report is due no later than 15 days prior to the expiration of this contract. D. Minimum Qualifications 1.U.S. citizen, subject to Department of State Secret level security clearance; 2.Bachelor's degree from an accredited institution and a minimum of 10 years related experience in law enforcement, with management experience in counter narcotics 3.Be physically qualified to live in Bolivia and to engage in frequent in-country travel to remote locations; and 4.Have knowledge and skill in the operation of desktop computer word processing systems. E.Evaluation Criteria Applicants who meet the minimum qualification requirements will be further evaluated to determine the extent to which their qualifications indicate that they possess the knowledge, skills, abilities and other characteristics described below: Factor 1.Offerors relevant experience in planning and developing law enforcement and strategies, training sequences and other related programs within developing countries and ability to coordinate with host country civilian and police officials and donor community. Offerors with specific experience working with Latin American Law Enforcement and Justice Administration will be given an additional five points. (35 Points) Factor 2.Offerors knowledge of program management policies, concepts, practices and principles in order to analyze and develop recommendations for program implementation and objectives of the USG. (25 Points) Factor 3.Offerors knowledge and experience in U.S. Government regulations, standards of conduct and ethics. (10 Points) Factor 4.Past performance evaluation of applicant’s ability to perform under the contract. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. (30 points) COMPENSATION Compensation for the position will be negotiated as follows: Level of experience will dictate the salary level within the grade range. Entry-level salary will normally be at the first step of the grade range for the position. However, consideration will be given to the successful applicant’s experience that is specifically relevant to the position to be filled. Number of years of relevant experience will determine at what step within the grade range the successful applicant will be compensated.
