Exceptions are also authorized to the statutory requirements in the Small Business Act (15 U.S.C. 637(e)) and the Office of Federal Procurement Policy Act (41 U.S.C. 416), to provide public notice of contracting opportunities. J&A FAR 6.302-1 - Services to provide Avian Injury Assessment NRDAR needs related to the Gulf Coast Oil Spill. 1. This action is in response to the MS Canyon 252 Oil Spill Response. This memorandum is to provide justification to procure the services from Biodiversity Research Institute as a sole source requirement because Biodiversity Research Institute includes development of avian specific NRDAR needs within USFWS, which will cut the procurement lead time. It is in the Government's best interest to procure this as a sole source based on the agreement the requiring activity has entered. 2. Description of Action:a. New Requirement: Technical assistance to include Development of avian specific NRDAR needs such as scopes of work, standard operating procedures, with literature reviews and other avian specific NRDAR needs.b. Time and Material: up until 5/31/2011; BRI team will respond to requests as needed, attend onsite meetings as needed, and serve as experts as needed.c. Funds: 40123-9812-00611 Y4 3. Reason for Authority Cited:a: Services are needed immediately to satisfy mission requirements and unacceptable delays will result when action is competed 7.
