Description
This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT under statutory authority, 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. The government intents to award a sole source (See approved sole source justification below) fixed price contract to Hershey Business Systems Inc., 14111 Freeway Dr Ste 100, Santa Fe Springs, CA 90670. If any interested parties can fulfill this requirement, please provide statement of interest to this office NLT 12:00 noon CDST on 28 Jun 2010. Electronic submissions are acceptable. ATTACHMENT: SUBJECT: Sole Source Justification, Purchase Request #F2XHC70131A002. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Contracting Activity: The 42nd Contracting Squadron, located at Maxwell AFB, Alabama 36112, is the contracting office for the requirements described herein. 1. Description of the supplies and services being acquired: The purpose of this acquisition is for the Community College of the Air Force (CCAF) to contract with Hershey Business Systems Inc. (HBSI) to provide software modules/subsystems, training, testing, consultation, documentation, installation, integration and options for maintenance to support the Singularity Application Package as described in the Statement of Work (SOW). The period of performance for these services is 1 Jul 2010 throught 30 Jun 2011. Purchase Request # F2XHC70131A002. The estimated contract value is $XXXXXX. Pertinent Information This action was previously awarded under sole source contract number FA3300- 09-P-0161 to Hershey Business Systems Inc. (HBSI) as the prime contractor to develop the web-enabled, enterprise-wide transcript processing and access management system known as Singularity. The previous acquisition was advertised on Federal Business Operations (FEDBiz Ops) as an intent to award a sole source contract to HBSI but no responses were received. 2. Statutory Authority Permitting Other than Full and Open Competition: The authority for this Sole Source acquisition is FAR Part 6.302-1(a)(2): "When the supplies or services required by the agency are available from only one responsible source, or, for DOD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." 3. Demonstration that the Contractor's Unique Qualifications or Nature of Acquisition Requires the use of the Authority Cited Above (Applicability of Authority): HBSI originally developed the Singularity Application Package and is the sole provider of this software and the only known source that can presently fill the unique licensing and maintenance requirements of this system. The software was developed and is maintained by HBSI and they maintain proprietary data rights. This software must be licensed annually and maintained through software updates, patches and additional capabilities. HBSI is the only provider for this license and the software updates, patches and additional capabilities. There is no other known software available for immediate implementation that can provide the capabilities and meet the mission requirements without an extensive transition period which would cost the government thousands of dollars and cause an unacceptable delay in mission accomplishment. HBSI has considerable knowledge of CCAF's Student Transcript, Administration and Record System (STARS), remote Education Services Offices access processes, and the integration and delivery of Electronic Data Interchange (EDI) 130 transaction files from the American Association of Collegiate Registrars and Admissions Officers (AACRAO) EDI server located on the University of Texas campus. HBSI, through its work on previous contracts, has acquired a thorough understanding of CCAF's business processes and has developed system specifications to enhance the tracking of scanned and electronically received transcript information into CCAF's STARS system. HBSI has worked with CCAF technical personnel to deliver out-bound sorting of transcript data from STARS and formatting electronic transcripts to conform to the 130 transaction set used by the AACRAO EDI server. HBSI has developed their expertise over the last 8 years by working with major higher education institutions similar to CCAF. Throughout this period, HBSI has developed a web-based framework that is compliant with a variety of products and services that enhance student success, credit transfer and records retention. This experience and understanding of CCAF processes and procedures cannot be duplicated without extensive extra cost to the government and unacceptable mission delays. 4. Conclusion: It has been determined through extensive market research that no other contractor who specializes in similar projects could accomplish the deployment and/or support the current application. In addition, current software codes developed, maintained and updated by HBSI, a comprehensive understanding of CCAF internal business processes developed through extensive experience in dealing with Air Force systems and CCAF systems in particular, along with HBSI expertise of external EDI transactions, support the fact that no other contractor but HBSI could provide the required and unique support necessary for the current application and its future enhancements. 5. Actions taken to preclude future sole source applications: As part of seeking potential sources the PCO published a notice of intent to award a sole source contract to HBSI on FedBizOps on 22 Jun 10. It requested that interested sources identify their interest and capability to respond to the requirement within 5 days after the publication date of this notice of contract action. CCAF will continue to closely monitor ongoing advancements and design innovations in the commercial computer software industry, and will actively solicit input from additional contractors in the future to assure full and open competition is available on all future acquisitions of this type. Contracting Officer's Certification The contracting officer's signature on this sole source document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12)).
