Description
The Bureau of Reclamation, Acquisitions Operations Group, supporting the Technical Service Center, Denver, CO intends to negotiate on a sole source basis with URS Group, Inc., 9901 W. Interstate 10, Suite 980, San Antonio, TX 78230-2252. The requirement involves providing continued environmental technical support services to the Bureau of Reclamation (Reclamation) at the Crab Orchard National Wildlife Refuge (Crab Orchard NWR). This is in support of an agreement entered into by the U.S. Fish and Wildlife Service (FWS) and Reclamation to implement response actions by FWS pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) to address the release of hazardous substances at Crab Orchard. The types of services performed under this contract include revision of the Community Relations Plan, review and submit comments on remedial action activities documents, develop an Operations and Maintenance Plan, data validation, draft and revise Post Remedial Action Monitoring (PRAM) Reports and analyze the effectiveness cleanup efforts. URS has provided technical assistance to Reclamation/FWS for all Crab Orchard NWR Operable Unit sites since 1998 and has become intimately familiar with all aspects of the response action activities of FWS at all seven OUs. As a result of the long term involvement of URS in CERCLA response activities at Crab Orchard and, in particular, the involvement of specific individuals employed by URS, maintaining the involvement of URS and these individuals is critically important to the success of FWS and DOI in preparing, prosecuting, and resolving through negotiations or litigation civil claims arising under CERCLA. Accordingly, Section 109(e) of CERCLA authorizes the use of non-competitive procedures to procure and maintain the services of these experts. Competition is restricted to only one source per FAR 6.302-1. In addition, Section 109(e) of CERCLA, 42 U.S.C. 9609(e) applies to this acquisition. This procurement will be awarded using FAR Part 15 Negotiation procedures resulting in an indefinite-delivery/indefinite-quantity procurement with a base year and four option periods. The base year is expected to begin August 1, 2010 and continue through July 31, 2011. This notice of intent is not a request for competitive proposals. However, capability statements received by 2:00 pm MST July 9, 2010 will be considered by the Government. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
