JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION This is a sole source procurement under the 'Other than Full and Open Competition' (FAR 6.302-1). The associated NAICS code for the maintenance and repair service from TCGrx contract is 541490. ASAO East 8 Department of Veteran Affairs intends to award a sole source contract for VAMC West Palm Beach for 24/7 phone support, maintenance, routine repair, and 4 hour on- site emergency service response for the TCGrx ATP 320 GA automated pill counter to, TCGrx, N1671 Powers Lake Road, Powers Lake, Wisconsin 53159. AUTHORITY CITED: A.) FAR 6.302-1 REASON FOR AUTHORITY: FAR 6.302-1: Market research found TCGrx is the manufacturer of the equipment and the only company with factory specialized technicians to work on the ATP 320 GA system and the only company authorized to operate TCGrx proprietary functional design. TCGrx is the only company with systems engineers and sales representatives that have been factory trained and certified to service all TCGrx equipment. In addition TCGrx has a strict warranty policy that states any work, replacement, reinstall, code modification/upgrade, or repair performed on TCGrx equipment components by parties other than TCGrx factory trained technicians will void both the standard and extended service warranties on the ATP 320 GA system. APPLICABLE CONDITIONS: The contractor shall provide services to the Department of Veterans Affairs Medical Center, West Palm Beach, Florida. The contractor shall provide maintenance/certification services in accordance with manufacturer's specifications. The services to be performed by the vendor will consist of the following, Inspection, preventative maintenance and repair of TCGrx ATP 320 equipment, instrumentation and electromechanical devices. Facilitation of service exchanges or repairs as requested or authorized by customer, daily management, and operation and troubleshooting support of all TCGrx products including all ATP 320 GA equipment. To include all labor, parts, phone, and travel to support the ATP 320 GA, for the purposes of reducing damage risks and incidents and promoting process improvements. Performance of routine, and, as requested, in-servicing on proper care and handling of TCGrx equipment. Organization and delivery of service activity reports, education, troubleshooting, process improvements and provide certification worksheets. The contract will be established for five years however the determination of needed services will be based on COTR and staff knowledge on operation of equipment. EFFORTS TO OBTAIN COMPETITION: This Notice of intent is not a request for competitive quotes. However, any firm that believes it can meet these requirements may give written notification to the Contract Specialist, who will evaluate all responses received. The determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government.
