Description
The National Institute of Standards and Technology (NIST) in Gaithersburg, Maryland intends to negotiate and award a purchase order using simplified acquisition procedures on a sole source basis under the authority of FAR 13.106(b)(1), with Bruker Optics, Inc. in Billerica, MA for the purchase of upgrade options for existing Bruker Optics, Inc. equipment and shall include a Bruker Optics, Inc. Model A741/Q temperature controlled flow cell and Bruker Optics, Inc. Model S129/8 fast scan option to allow rapid scan capabilities and any additional required components for upgrading the existing equipment. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500. The components required shall be an upgrade to an existing Bruker Optics, Inc. Model Vertex 80 fourier transform infrared (FTIR) spectrometer which was originally purchased from Bruker Optics, Inc. Bruker Optics, Inc. is the only company that can provide a compatible upgrade. In additional to general compatibility issues, the flow cell and software represent a system that Bruker Optics, Inc. has designed and calibrated to measure protein secondary structure. Using parts not included in the calibration process would invalidate the process. Different aperture sizes, cell thicknesses and fringing characteristics for other cells make it impossible to mix parts and get accurate data. The required upgrades of the Vertex 80 fourier transform infrared (FTIR) spectrometer, can only be obtained from Bruker Optics, Inc. because they are manufactured and sold by Bruker Optics, Inc and there are no other distributors. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by July 14, 2010 will be considered by the Government. A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
