Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION41 USC 253c (1)ONLY ONE RESPONSIBLE SOURCE ANDNO OTHER SERVICES WILL SATISFY AGENCY REQUIREMENTS AUTHORITYIn accordance with FAR 6.303 and 6.304, this justification to enter into a contract with Rolls-Royce Navel Marine Inc, under the authority of 41 USC 253c (1) as outlined in FAR 6.302-1, is herein prepared on behalf of the Department of Interior, National Park Service, and the Ohio Major Acquisition Buying OfficeBACKGROUNDDue to the designed mission of the MV Ranger III and the Subchapter-H designation by the USCG, the vessel is an "Inspected Vessel" and is under the purview of the USCG and American Bureau of Shipping standards. The operating systems on board the vessel were designed and installed by Rolls-Royce Marine Inc. On June 08, 2010 while underway from Houghton, MI to Isle Royale the vessel suffered a failure of the remote propulsion controls due to loss of power and was forced to suspend the voyage and contact the USCG. The USCG Marine Safety Office suspended operation of the vessel through a CG-835 until an OEM technician from Rolls-Royce Marine could perform an analysis of the system and determine cause of failure and provide a report on corrective measures and repairs. Through this process it was determined that the vessel does not have "True" alternative manual control of engine RPM or pitch control of the propulsion system from the pilot house or engine room in case of emergencies such as loss of power. The USCG has given the NPS until July 29, 2010 to correct these deficiencies that were identified or use of the vessel will be cancelled indefinitely until repaired and inspected. Due to the complexity of the on board operating systems and the design by Rolls-Royce Marine and proprietary controls over design and required computer operating programs Roll-Royce Marine is the only vendor that can perform the required design and installation of equipment to perform repairs to meet USCG Marine Safety Office 835 and 46CFR62.25-10, 46CFR62.35-(b) and 46CFR62.30 to place the MV Ranger III back in operation and insure the safety of the vessel and passengers. JUSTIFICATIONIn accordance with FAR 6.303-2, the following facts and rationale is provided for the justification of a single-source procurement. 1.Agency: Department of the Interior, National Park ServiceContracting Activity: Ohio Major Acquisition Buying Office 2.Description of Action Being Approved: Single source procurement to Rolls-Royce Naval Marine rd to provide final design, software update and resolution to the propulsion system failure. 3.Description of the Supplies or Services: Emergency Repairs, design services for controls and computer operating programs for the Roll-Royce propulsion system of the Ranger III, Isle Royale National Park, Houghton, MI. 4.Statutory Authority Permitting Other than Full and Open: FAR 6.302-1(b)(2) and 6.302-2(a)(2)(b)(1)(2). 5.Contractor's Unique Qualifications: Complexity of the on board operating systems and the design by Rolls-Royce Marine and proprietary controls over design and required computer operating programs Roll-Royce Marine is the only vendor that can perform the required design and installation of equipment to perform repairs to meet USCG Marine Safety Office 835 and 46CFR62.25-10, 46CFR62.35-(b) and 46CFR62.30 to place the MV Ranger III back in operation and insure the safety of the vessel and passengers. 6.Effort to Ensure Offers are Solicited: GSA advantage was researched to see if any vendors were capable of designing, providing design results, and repairing the Rolls-Royce Marine propulsion system. Three (3) vendors stated that the system contains proprietary controls and is not on the GSA contract but instead may try open market. However, portions of the system remain proprietary and would require additional costs for design of the repairs from Rolls-Royce Marine. 7.Costs are Fair and Reasonable: It has been determined, based on the previous work performed by this company and the government estimates for this work, that the anticipated cost to the government for this follow-on work will be fair and reasonable. 8.Market Research: GSA advantage was researched to see if any vendors were capable of designing, providing design results, and repairing the Rolls-Royce Marine propulsion system. Three (3) vendors stated that the system contains proprietary controls and is not on the GSA contract but instead may try open market. However, portions of the system remain proprietary and would require additional costs for design of the repairs from Rolls-Royce Marine. 9.Rolls-Royce Marine and proprietary controls over design and required computer operating programs. Roll-Royce Marine is the only vendor that can perform the required design and installation of equipment to perform repairs to meet USCG Marine Safety Office 835 and 46CFR62.25-10, 46CFR62.35-(b) and 46CFR62.30 to place the MV Ranger III back in operation and insure the safety of the vessel and passengers.
