Description
This is a combined synopsis/solicitation for commercial itemsprepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and A WRITTEN SOLICITATION WILL NOT BE ISSUED separate from this announcement. Solicitation DE-RQ65-10WG87328 is issued as a Request for Quotation (RFQ). You may submit your written quote on company letterhead or Standard Form 1449. The solicitation document and incorporated provisions and clauses are those in effect through FAR Federal Acquisition Circular 2005-42. This solicitation is 100% small business set-aside. The North American Industrial Code (NAICS) is 335911 and the business size standard is 500 employees or less. A fixed price contract will be awarded using Simplified Acquisition Procedures. The U.S. Department of Energy, Western Area Power Administration, Desert Southwest Customer Service Region requires HOPPECKE BATTERY BRAND NAME ONLY: CLIN 0001 Battery system with accessories (Armagosa) Quantity is 1 JB. CLIN 0002 Spill Containment System (Armagosa) Quantity is 1 JB. CLIN 0003 Uninstall/Remove/Unload/Install old and new batteries and spill containment. (Armagosa) Quantity is 1 JB. CLIN 0004 Battery system with accessories (Hassayampa Tap) Quantity is 1 JB. CLIN 0005 Spill Containment System (Hassayampa Tap) Quantity is 1 JB. CLIN 0006 Uninstall/Remove/Unload/Install old and new batteries and spill containment. (Hassayampa Tap) Quantity is 1 JB. CLIN 0007 Battery system with accessories (Blythe) Quantity is 1 JB. CLIN 0008 Spill Containment System (Blythe) Quantity is 1 JB. CLIN 0009 Uninstall/Remove/Unload/Install old and new batteries and spill containment. (Blythe) Quantity is 1 JB. In accordance with the specifications and Brand Name justification attached to this announcement. The following clauses and provisions apply to this solicitation: 52.212-1, Instructions to Offerors -- Commercial. Please submit the product information, manufacturer and part number of item you will be supplying. FOB Destination to destinations stated in the Specifications. 52.212-2, Evaluation -- Commercial Items. The Government intends to award to the responsible contractor whose quotation is the most advantageous to the Government, considering price and price-related factors and technical compliance. Technical specification compliance is significantly more important than price. 52.212-3, Offeror Representations and Certifications -- Commercial Items. * All firms or individuals submitting a quote shall include a completed copy of this provision, or include a completed copy of the Online Representations and Certifications Application (ORCA). Contractor shall acknowledge in their quote that their ORCA (Online Representation and Certification Application) is current and up to date, located at: https://orca.bpn.gov/. If your ORCA is not current and/or you do not submit a completed copy of this provision, your quote will be considered non-responsive. 52.212-4, Contract Terms and Conditions -- Commercial Items and addenda to the clause. WES-H-1024 Lobbying Restrictions (WAPA, FEB 2008) The contractor agrees that none of the funds obligated on this award shall be expended, directly or indirectly, to influence Congressional action on any legislation or appropriation matters pending before Congress, other than to communicate to members of Congress as described in 18 U.S.C. 1913. This restriction is in addition to those prescribed elsewhere in statute and regulation. WES-H-1025 Requirement For Purchasing of American-Made Equipment and Products (WAPA, FEB 2008) It is the sense of the Congress that, to the greatest extent practicable, all equipment and products purchased with funds made available under this award should be American-made. WES-H-1051 Energy Efficiency in Energy Consuming Products (WAPA, JULY 2006) When the contract requires the specification or delivery of energy consuming products for use in a Federal facility, the contractor will specify or deliver ENERGYSTAR qualified products or products conforming to the Federal Energy Management Programs (FEMP) Energy Efficiency Requirements, whichever may be applicable, provided products with such a designation are available and are life cycle cost effective and meet applicable performance standards. Information about these products is available for ENERGYSTAR at http://www.energystar.gov/products and FEMP at http://www1.eere.energy.gov/femp/procurement/eep_requirements.html 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items. The following additional FAR clauses cited in the clause are applicable to the acquisition. 52.219-6 Notice of Total Small Business Aside; 52.222-19 Child Labor-Cooperation with Authorities and Remedies; 52.222-21 Prohibition of Segregated Facilities; 52.222-26 Equal Opportunity; 52.222-36 Affirmative Action for Workers with Disabilities; 52.222-50 Combating Trafficking in Persons; 52.223-15 Energy Efficiency in Energy-Consuming Products; 52.225-13 Restrictions on Certain Foreign Purchases; 52.232-33 Payment by Electronic Funds Transfer-Central Contractor Registration. If a change occurs in this requirement, only those offerors that respond to this announcement within the required time frame will be provided any changes/amendments and considered for future discussions and/or award.
