Description
THIS NOTICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY: The purpose of this special notice is to provide public disclosure of the Justification and Approval documentation for a sole source modification. The Iowa National Guard located in Johnston IA wishes to modify the existing contract number W912LP-09-C-0002, Remodel of the Vehicle Maintenance and Communication Training Complex, project number HEMT039066 for the, Iowa Air National Guard, 133 Test Squadron, located at the Fort Dodge Air Station in Fort Dodge, Iowa. The modification would change the mechanical systems of the existing Communications Facility to allow for a Geothermal System. The work consists of the following (interior work only, which is currently being renovated): new heat pumps and controls to replace the existing fan coil units. The work includes new pumps, filters, a separator, expansion tank, glycol solution make up unit, and piping to and from the new heat pumps as well as new ducts and diffusers. A dishwasher hood and exhauster were added for the kitchen. Demolition work includes removal of all fan coil units and associated controls, supply air ductwork, diffuser, return grilles, and HVAC heating piping and chilled water piping from the fan coil units as well as removal of boilers, pumps, and associated equipment, and a condenser. Also included is the demolition of ceilings that is not included in the original scope of work (contract W912LP-09-C-0002), and new light fixtures for these ceilings. Control Number: 10-09 Mini Justification and Approval Document FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: United States Property and Fiscal Office for Iowa Attention: USPFO P&C Building #W41, Camp Dodge Johnston, Iowa 50131-1824 2. Nature and/or description of the action being approved: The prposed action would modify the existing contract number W912LP-09-C-0002, Vehicle Maintenance and Communication Training Complex at the Fort Dodge Air Station in Fort Dodge, Iowa. The modification would change the mechanical systems of the existing Communications facility to allow for a Geothermal System. 3. Description of the supplies or services required to meet the agency's need to include estimated value: The work consists of the following interior work: new heat pumps and controls to replace the existing fan coil units. The work includes new pumps, filters, a separator, expansion tank, glycol solution make up unit, and piping to and from the new heat pumps as well as new ducts and diffusers. Also included is the demolition of ceilings in addition to those already being removed under the base bid and new light fixtures for these ceilings. A dishwasher hood and exhauster were added for the kitchen. Demolition work includes removal of all fan coil units and associated controls, supply air ductwork, diffusers, return grilles, and HVAC heating piping and chilled water piping from the fan coil units as well as removal of boilers, pumps and associated equipment, and a condenser. 4. Authority Cited: (Identify the statutory authority, FAR title and FAR citation permitting other than full and open competition) 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. (a) Authority. (1) Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). (2) When the supplies or services required by the agency are available from only one responsible source, or, for DOD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.... (iii) For DOD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in-- (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).)... 5. Reason Authority Cited: The Iowa National Guard determined that the mechanical system in the Communications Facility needed to be modified from the proposed upgrades in the existing system to a geothermal system to increase the energy efficiency of the facility. The original plans and specifications required the modification and alteration of the interior of the facility along with upgrading the existing mechanical systems. The proposed change to a geothermal system will require work that was previously outlined in the plans and specifications to be deleted from the original scope of work; in addition, to adding new work to accommodate the geothermal system. The undersigned has concluded that the agency's minimum needs can only be satisfied by the original offeror due to the work being deleted from the original plans and specifications and the addition of the new work. Using a third party would result in significant challenges and possible duplication in efforts trying to coordinate work being deleted from the original contract and the new work required for the geothermal system by the third party. Therefore, the undersigned believes it is in the government best interest to restrict competition on this change order. 6. Actions to Increase Competition: The Government will request the General contractor to promote competition to the maximum extent possible amongst their subcontractor and suppliers. However, based on the fact the items will be deleted from the original scope of work the possibility of competition amongst the subcontractors and suppliers will be limited. 7. Market Research: Market research was not conducted because the Government is deleting work from the original scope of work. Having two separate contracts would result in duplication in efforts and possible additional cost to the Government for conflicts between the two contracts (if two separate contracts were awarded). 8. Other Interested Sources: No other source has expressed an interest at this time; however, other sources may include the mechanical and electrical subcontractors in the Fort Dodge area. 9. Subsequent Acquisitions: This is an isolated situation and the undersigned does not anticipate this type of change order on future construction project. 10.
