- Justification for Other Than Full and Open Competition In accordance with FAR 6.302 and 6.305, this notice of contract award is posted. (1).Nature and/or description of the action being approved. Justification to enter into a contract with other than full and open competition based upon Unusual and Compelling Urgency, 41 USC 253(c)(2). (2).Description of the supplies or services required to meet the agency's needs (including the estimated value). Conduct testing to determine affect, if any, Electro-Magnetic Interference may have on operation of certain automobiles. Ceiling Amount of the contract is established at $211,625.00. (3).Statutory authority permitting other than full and open competition: 41 U.S.C 253(c )(2). (4).A demonstration that nature of the acquisition requires use of the authority cited. In order to meet an Agency-established deadline for reporting to Congress, research and reporting on the affects Electro-Magnetic Interference (EMI) may have on the operation of certain automobiles must be completed by no later than August 31, 2010. The need to use an advanced test facility to support this requirement was not identified until early June 2010 leaving less than three months to complete the project. Meeting the August 31, 2010 deadline would not have been possible if full and open competitive procedures were followed. (5).A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: Do to the unusual and compelling urgency associated with this unique project, soliciting offers from more than one source was not possible. (6).A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The government will be paying established catalog prices offered to all the contractor's customers. (7).A description of the market research conducted and the results or a statement of the reason market research was not conducted. Market research was conducted to the extent time permitted. Through this market research, the government was able to identify the contractor which would best fulfill the technical need of this contract within the established time constraints. (8).Other information: Due to the unique nature of this procurement, a similar follow-on procurement is not expected. If, in the unlikely event a follow-on procurement is required, then competition will be sought to the maximum extent practicable. A contract for which this Justification for Other than Full and Open Competition was prepared was awarded on June 23, 2010 to Chrysler LLC of Auburn Hills, MI in the amount of $211,625.00.
