- Justification for Unusual and Compelling Urgency ICO 674-10-3-5122-0054 1. Requesting Agency: Environmental Management Service (137), Central Texas Veterans Health Care System, 1901 S. 1st Street, Temple, Tx 76504 2. Contracting Agency: Central Texas Veterans Healthcare System, 1901 S. Veterans Memorial Drive, Temple, TX 76504 3. Description of Action: The requirement is to purchase services for bat removal devices and total elimination of bat population for the CTVHCS Temple buildings 202 and 204, Temple, Texas 76504. 4. Description of the Service: The contractor shall provide bat removal devices and total elimination of bat population for building 202 and 204, Temple, Texas 76504 and provide 5 year warranty for services per pest controller Charles Walker. The estimated dollar value is $88,375. 5. Authority Cited: FAR 6.302-2 Unusual and Compelling Urgency: Existing service was done by VA pest controller only one responsible source and no other supply will satisfy the Agency requirement. Service must start on July 12, 2010 to insure completion of bat exclusion services as the continued of bats at the Temple VA present a health and infection control issues due to guano (Bat droppings) and the possibility of the bats carrying rabies. 6. Reason for Authority Cited: The presence of bats in buildings 202 and 204 present a health and infection control issues due to guano (Bat droppings) and the possibility of the bats carrying rabies. In order to safeguard patients and staff and visitors these buildings must be corrected to eliminate roosting of bats at these facilities. (i) What harm will come to the Government if desired supplies/services are not provided on time? Service must start on July 12, 2010 to insure completion of bat exclusion services as the continued of bats at the Temple VA present a health and infection control issues due to guano (Bat droppings) and the possibility of the bats carrying rabies. 7. Efforts to Obtain Competition: The services are not available from General Services Administration Schedules or from any other open market source due to the urgency and uniqueness referenced in paragraph 6. In accordance with FAR 5.202 (a)(2) Exceptions to Synopses of proposed actions due to urgent and compelling. 8. A determination by the Contracting Officer of Fair and Reasonable: Based on the foregoing conclusion, I hereby approve the above requirement services on other than full and open competition basis and urgent and compelling. Pursuant to authority of 10 U.S.C. 2304 ( c ) (2), subject to availability of funds, and provided that the services herein described have otherwise been authorized for acquisition. I hereby determine that the anticipated cost for this contract will be determined to be fair and reasonable, derived from comparison to the independent government estimate. 9. Market Survey: See paragraph 6. 10. Any other factors supporting the use of other than full and open competition and urgent and compelling: N/A 11. Interested Sources: No other authorized sources are available to meet the immediate requirements for the Temple VA. 12. Requirement: I certify that the supporting data, including the statement of the Government ™s minimum needs and other rationale for the other than full and open competition and urgent and compelling is complete and accurate to the best of my knowledge.
