Contract No 40181AM391 Project: Oil Spill TAS: 14 1611 This J & A is also available at: http://www.fws.gov/contracts/ja.aspx?id=3AD2321C-BB9B-4500-A19E-73402109912C United States Department of the Interior Class Justification and Approval for Other Than Full and Open Competition and Waiver of Publication Requirements Federal law 10 USC 2304 (c) (2), 41 US.C. 253(c)(2) and FAR 6.302-2, Unusual and Compelling Urgency authorizes under certain conditions, contracting without providing for full and open competition. Exceptions are also authorized to the statutory requirements in the Small Business Act (15 U.S.C. 637(e) and the Office of Federal Procurement Policy Act (41 U.S.C. 416), to provide public notice of contracting opportunities. J&A FAR 6.302-2 - SOLE SOURCE JUSTIFICATION 1. Organization: U.S. Fish and Wildlife Service, Southeast Regional Office, 1875 Century Boulevard, Atlanta, Georgia 30345. 2. Description of Action: a. Approximately 819 Room nights at the La Quinta Hotel/Panama City Beach, FL ($88,805.00) 3. Name of Intended Contractor: Islander Motel, L.L.C. DBA: La Quinta 7115 Coastal palms Blvd Panama City, FL 32408-4986 4. Statutory Authority: The authority permitting other than full and open competition for this acquisition is 41 USC 253 (c) (1), which is cited under FAR 6.302-2. Unusual and Compelling Urgency 5. Justification/Reason for Soliciting Only One Source: Hotels were needed to accommodate responders working on the MS Canyon 252 Oil Spill. a. What harm will come to the Government is desired supplies/services are not provided on time? Individuals working on this detail will be working weekends and nights. A hotel which is in close proximity to their work site is required to enhance their ability to do their job and to ensure their safety. b. What harm will come to the Government if desired contractor does not receive the award? There can be delays in response time for staffing involved with the spill which may result in undue harm to land, resources, wildlife, and/or humans. 6. Action to Increase Competition: a: Other Hotels were called and surveyed for availability. 7. Market Survey: Area hotels were called. 8. Procurement History: a: Previous contract/order number: N/A b: Previously competed: N/Ac: Previous authority for less than Full & Open Competition: N/A 10. Price Reasonableness: The quoted price is comparable to other Hotel facilities in the area. 11.
