- This action has been awarded under the American Recovery and Reinvestment Act(ARRA) of 2009. In compliance with this Act, the Government posts this notice that TaskOrder (TO) 40 was issued under contract NNJ08JB01C, the Environmental Contract, toprocure environmental services in support of a construction of facilities (CoF) Projectto repair and waterproof precast exposed aggregate faced (PEAF) panels on thirtybuildings at the Johnson Space Center. The environmental services include oversight forenvironmental compliance and disposal of caulking containing Polychlorinated biphenyls(PCBs) and project and field activity oversight for compliance with JSC Policies andProcedures (JPR), applicable permits, and other applicable regulatory constraints. Thecontractor shall obtain and track usage of air emissions; 9 volatile organic (compounds)for the purpose of assessing conformance with Texas Commission on Environmental Quality(TCEQ) air regulations. In addition modification 93 was issued for funding Task Order 40.<P>The Environmental Contract was awarded on a competitive basis. These Task Orders wereissued under the cost-type contract arrangement in accordance with the contract. Acost-type arrangement is appropriate due to uncertainties involved in contractperformance that do not permit costs to be estimated with sufficient accuracy to use anytype of fixed-price contract. In addition, a cost-type contract was selected to providethe contractor the greatest incentive for efficient and economical performance, given thetypes of services to be performed. This Environmental Contract has experienced personneland documented performance to mitigate the Government's risk. In order to meet therequirements of the Recovery Act in the most prudent business manner, with the timeconstraints imposed, the existing Environmental Contract is the most appropriatecontractual vehicle for the work required.
