- RECOVERY - This procurement is being funded via the American Recovery and Reinvention Act of 2009 (ARRA).The Bureau of Reclamation, PN Water Quality Laboratory, Boise ID, has a requirement for a Seal Analytical Auto-Analyzer and a Seal Analytical Multi-Test Manifold.Reclamation seeks to contract on a sole source basis with Seal Analytical Inc. The authority for use of other than full and open competition for this transaction is implemented by FAR 6.302(2)(1): these particular pieces of equipment are the only configurations that meet Reclamation's Water Quality Laboratory needs. The analytical auto-analyzer is the only configuration that meets Reclamation's Water Quality Laboratory needs without modification or purchase of additional equipment and components in order to obtain the same level of functionality.The Seal Auto Analyzer is identical to two other instruments at the Water Quality Laboratory. Procurement of an analyzer from a different manufacturer or supplier would necessitate the purchase of new software, additional training costs as well as parts inventory in order to accomplish the same objectives. The Seal Analytical Multi-Test Manifold: This piece of equipment is a module that installs directly onto an existing analyzer at the laboratory. The purpose of this manifold is to analyze additional constituents utilizing existing equipment and software. The Multi-Test Manifold fits the existing Flow Analyzer at the Water Quality Laboratory without hardware modifications or pump changes in order to incorporate this additional piece of equipment. Software necessary to process, as well as analyze the constituents is currently owned by the laboratory. Procurement of a multi-test manifold from a different manufacturer or supplier would necessitate the purchase of a new flow analyzer to receive the manifold component, new software and additional training costs in order to accomplish the same objectives. The Government believes that only one responsible source can provide the equipment listed above that will satisfy the agency's need. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Please be advised that the Awardee will be subject to Section 1512(c) of the Recovery Act, which requires that each contractor report on its Recovery Act funds under the awarded contract.
