DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, VA Puget Sound Medical Center 2.Description of Action: This is a request for other than full and open competition for the procurement of a freezer and refrigerator emergency service/repair contract from Spectrum Services for a period of 21 July 2010 through 30 Sep 2010. Spectrum Service 2720 Rucker Ave Ste 101 Everett, WA 98201 1-253-850-7754 3.Description of Supplies or Services: i.Emergency response calls to core-use freezer and refrigerator failures to be established through a blanket purchase order. All repair calls will be billed against this purchase order. ii. This will include all lab refrigerators, lab freezers, walk-in refrigerators/freezers, and refrigerator/freezer dependent equipment. iii. Same day emergency response, 24 hours/day, 7 days/wk. iv. Charges: labor $104.00/hr., one time per job truck fee $39.00, overtime rates apply outside of regular work hours. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (X) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: This purchase order will support the research program at the VA Puget Sound Medical Center by protecting irreplaceable research materials that are generally stored under ultra-low freezing conditions. The loss of one freezer can result in the loss of millions of dollars worth of samples and biological constructs. The mission of the VA is enhanced by protecting critical resources necessary for the advancement of scientific discoveries that directly and indirectly benefit veterans. 6. Actions to Promote Competition: In the future, the contracting officer will conduct additional market research for vendors who are certified to diagnose and repair these refrigerators. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 15,000. Previous Purchase Order (D06010) $20,000 was for similar service. The contracting specialist has determined the price to be fair and reasonable. 8.Market Survey (FAR 10): Spectrum Service is a local small business. Market Research indicated that there were only two companies that can diagnose and repair negative 80 degrees or lower freezers.
