- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-2, 41 U.S.C 253 (c) (2) - UNUSUAL AND COMPLELLING URGENCY CONTRACTOR: INTUITIVE SURGICAL 1. Agency and Contracting Activity Identification: VISN 22 Network Contracting Activity, 5901 E. 7th Street, Long Beach, California, as requested by VA Long Beach Healthcare System (VALBHS), will enter into an agreement that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Intuitive Surgical will furnish and assemble a camera head to an existing Da Vinci Robotic Surgical System. 3. Description of Requirement: VA Long Beach Healthcare System is requesting sole source procurement with Intuitive Surgical for a 3DHD Panasonic camera. Estimated cost is $40,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The acquisition is being procured under the authority of 41 U.S.C. 253 (c) (2), FAR Part 6.302-2 (a) (2). 5. The Nature of the Acquisition Requires Use of the Authority Cited: This agreement is being procured on a sole source basis because the medical equipment must be compatible with the Government owned Da Vinci Robotic surgical system that was purchased from Intuitive surgical in 2008. VALBHS has a maintenance contract however the camera was dropped by a VA employee, therefore the part is not covered under the maintenance contract. Intuitive Surgical will assemble at no additional cost to VALBHS. It is imperative that the camera is replaced immediately, Da Vinci Robotic cannot function properly without the camera and all surgery would have to be cancelled until the camera is replaced and this would jeopardize patient care. This equipment is the only one that will satisfy all of the VA's requirements within the time allotted. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A noticed was not synopsized/ competed because this is an emergency. See item number 5 above. 7. Anticipated Cost: The anticipated cost for the Da Vinci Robotic System should be fair and reasonable to the government based on the using service estimate and past prices paid for Da Vinci Robotic System. 8. Results of Market Survey: Market research was obtained from GSA/ FSS, and no other company was able to provide the proprietary equipment (camera) for Da Vinci Robotic Surgical System. The Vet Biz website was also researched and Intuitive Surgical is not a Veteran Owned Company. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-2, 41 U.S.C 253 (c) (2) - UNUSUAL AND COMPLELLING URGENCY CONTRACTOR: INTUITIVE SURGICAL 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? There are no other sources that expressed in writing an interest in the procurement. See Item 5 and 6 above. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: The anticipated life of government equipments are estimated approximately twenty (20) years. VHLBHS plans to maintain Di Vinci Robotic properly in order to maximize usage. In order to overcome barriers to competition, the Government shall research other surgical equipment before the procurement of a new system. 12.
