Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, VA Puget Sound Health Care System. 2.Description of Action: This is a request for other than full and open competition for the procurement of miscellaneous roof repairs on several Seattle Division buildings from O'Neill Contracting, Inc. (a 100% SDVOSB roofing contractor). 3.Description of Supplies or Services: Replacement of the B100 4th floor roof. Repair (not replacement) of various defects (install roof patches, repair parapet flashing, repair utility penetrations, repair roof drains) on Seattle Division B1 and B100 buildings. This proposed work will address current roofing leaks with replacement of one roof and repair work on several other roofs that will extend overall roof life expectancy. The VA PSHCS strongly desires a roofing contractor to perform this work rather than a general contractor. Construction cost estimate is $350,000 for all portions of the work (replacement and building roof repairs). The VA PSHCS system wants award by June 25, 2010 and work completed by September 30, 2010. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( X ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: 819.7007 Sole source awards to service-disabled veteran-owned small business concerns. (a) A contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. (b) The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. (c) When conducting a SDVOSB sole source acquisition, the contracting officer shall ensure businesses are registered and verified as eligible in the VIP database prior to making an award. 6.Actions to Promote Competition: Construction contracts are normally competed however on rare occasions a sole source selection is in the best interests of the government and can insure a quality product. It is this Contracting Officer's experience that sole source is seldom used for construction projects and that Puget Sound Health Care System fully supports and promote competition. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 350,000.00. The RFP price response will be compared to the existing market survey pricing and the RS Means construction industry pricing guide. 8.Market Survey (FAR 10): VA PSHCS Facility Management Service requested an independent roofing contractor to evaluate the roofing condition of these buildings and to provide a cost estimate for the repair work for budgetary purposes. 9.Other Considerations: O'Neill Contracting has performed roof repair work in the past at the Seattle Division. They have been willing to work around the facility's frequent requests for temporary work stoppages. Their past performance has been excellent. They have provided very good workmanship and, most importantly, have been willing to suggest alternate repair processes due to unforeseen site conditions. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: None 11.Statement of Actions to Overcome Barriers to Competition: Open competition is normally used for construction projects. Only on rare occasions has the sole source option been used. Projects are prepared timely and allow adequate time for full and open competition. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. _____________________________________________________ Name: William W.
