Description
The U.S. Department of Commerce, National Oceanic and Atmospheric Administration (NOAA),, Simplified Acquisitions intends to negotiate on a sole source basis with Timewave Technology, Inc. using procedures in FAR Parts 6 and 13. The NWS, Services Branch has a requirement to purchase 8 Timewave units (DSP-D300E). These units (DSP-D300E) allow Automated Local Evaluation in Real Time (ALERT) data to be decoded and sent over the Internet. This, in turns, allows the data to be processed at a NWS facility for display over the Web to the public and dissemination to Weather Forecast Offices (WFOs). The ALERT data to be sent is rainfall and stream data collected through the Passaic Flood Warning System (PFWS). The PFWS operates rainfall and stream gages in the Passaic River Basin of New Jersey. The PFWS is operated and maintained by the NWS through a Memorandum of Understanding (MOU) with the New York District office of the United States Army Corps Of Engineers (USACE). The PFWS is a 24/7 operation that sends important weather-related data to the NWS for dissemination to NWS field offices for use in issuing watches and warnings. Timewave is the only company producing a device capable of filtering ALERT radio signals, decoding the ALERT data from these radio signals, and then encapsulating the ALERT data or message in Internet Protocol (IP) for transmission over the Internet. The contractor Timewave built the DSP-D300 for the National Weather Service under a competitive bid. The DSP-D300E meets the needs of the National Weather Service and Timewave, Inc. is the only vendor that produces such a unit. The statutory authority for other than full and open competition is 41 USC 253(c)(1) as implemented by FAR 6.302-1, Only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 334515, 500 employees small business size. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements. Responses must also be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the quote meets all of the foregoing requirements. Capability statements and related materials must be e-mailed to Amy.Sanderswhite@noaa.gov or faxed to (301) 713-0808 by August 3, 2010. Award will be made using FAR 13, Simplified acquisition procedures, current through FAC 2005-44. The determination to compete or not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
