Description
Clarification #2 to LISC RFI#3 Clarification #2 to Request For Information (RFI) #3 I. Description / Purpose: 1. A company responded to the NAICS code change posting with commentary on the change in NAICS code and how it might affect potential small business participation or set-aside possibilities on LISC. The response was neither formatted per either RFI#2 or RFI #3 requirements, nor addressed the questions posed by either RFI in the manner required. Because the company is a RFI#2 respondent, it therefore has the right to issue a revised response to RFI#2. The communication demonstrated lack of full awareness of the potential impacts of the NAICS code change, as well as the Government's rationale for the change. The Government decided to treat this communication as a query instead of a RFI response and issued the following clarification: SMC's response: If your response to RFI #2 will change as a result of the change in the NAICS code, please resubmit your RFI#2 response by July 26, in the template you used to originally respond. Please note that this NAICS code applies only to the prime contractor (or the prime team's components) on the contract. NAICS codes for subcontracts are chosen by the prime contractor but must be defended as appropriate in light of the work to be performed on the subcontract. Regarding RFI#3, any small-business set-aside(s) based on requirements currently encompassed by the LISC PWS might warrant a different NAICS code, depending on the work to be performed on the set-aside(s). If you identify any such set-aside(s) as possible, please make sure you defend the use of the NAICS code you believe applies to that set-aside. Regarding our final choice of NAICS code, we have always maintained that everything we have briefed on LISC is pre-decisional and subject to change. We have yet to go to ASP. SMC/BC has also been in agreement with the LISC program office since last November that the NAICS code previously used (541712) was not the correct one for LISC because it applies primarily to R&D work, which will be minimal on LISC. The LISC program office and SMC/BC then resolved to revise the NAICS code as soon as practicably possible. Our decision was not made based on business size but on which NAICS code best captured the most requirements on LISC. This exchange with SMC/BC is well documented internally. The LISC program office did not make this decision either from within a vacuum or without considering the impacts to small business. We remain committed to maximizing the amount of work for small business as a part of LISC, while ensuring mission success and not threatening the efficiencies the Government expects to gain from LISC. 2. A company requested clarification regarding suspenses. SMC's Response: 1) Revisions to RFI#2 are due NLT COB July 26. Only companies that previously responded to RFI#2 may submit revisions to RFI#2. 2) Responses to RFI#3 are due NLT COB July 28. 3. A company asked whether 9pt font could be used in tables and graphics. SMC's response: Yes, this is acceptable. II.
