- CMS issued a T&M Contract (HHSM-500-2010-00024C) on a sole source basis under authority of FAR 19.8 "Contracting With The Small Business Administration (The 8(a) Program). The T&M effort shall assist the CMS and the responsible FMSG project office; implement the HITECH incentive payment program created under Title XXX of Division A, and Title IV of Division B of the American Recovery and reinvestment Act of 2009. The legislation establishes a required incentive-payment system start date of October 1, 2010 for hospitals and chronic care facilities, and January 1, 2011 for other medical services providers. The T&M was awarded because it was not possible to estimate accurately the extent of the work needed with any degree of confidence. The requirements of the SOW are unique, non-repetitive, and the work is non-severable. By the nature of the activity, operational auditing to access and document readiness and gaps, specific labor requirements can only be estimated in terms of types of labor, and quantities of hours, as specific issues to be found are unknown at this time.
