1.CONTRACTING ACTIVITY: Department of Veterans Affairs Consolidated Contracting Activity-VISN 21 2.NATURE/DESCRIPTION OF ACTION: VA Palo Alto Health Care System (PAHCS) has a requirement for the sole source (brand name) procurement of Medtronic Nerve Integrity Management (NIM) Nerve Monitoring System with cart, printer, and screen. 3.DESCRIPTION OF SUPPLIES/SERVICES: The following line items are required for this procurement: NX EQUIPMENT: 1 BUNDLE, NERVE INTEGRITY MANAGEMENT, RESP. 3.0, w/CART/PRINTER/SCREEN 1 EA 4.AUTHORITY CITED: FAR 6.302-1, 41 U.S.C 253 (c )(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and 6.302-1 (c ) Application for brand name description. 5.REASON FOR AUTHORITY CITED: Due to the increase in complexity of traumatic brain injury (TBI) surgeries, VAPACHCS requires a surgery monitoring system which monitors real-time electromyographic (EMG) activity from multiple muscles using APS electrodes during minimally invasive or traditional open surgeries, allows surgeons to identify, confirm, and monitors motor nerve function to reduce the risk of nerve damage during a variety of surgical procedures, provides visual and audible warnings when changes occur, contains artifact detection software reducing noises, and includes multiple USB ports for rapid patient documentation. The new Medtronic NIM nerve monitoring system provides all requirements. It has been determined that this procurement falls within this category. Only one responsible source and no other suppliers will satisfy agency requirements. 6.EFFORTS MADE FOR SOLICITING FROM OTHER VENDORS: No other vendors could be located that provided a product which met the same functionally requested by the customer. 7.FAIR AND REASONABLE DETERMINATION: A Price Negotiation Memorandum (PNM) will detail how the Government has determined that the anticipated costs will be the fair and reasonable in accordance with FAR 13.0106-3. 8. MARKET RESEARCH: In accordance with Federal Acquisition Regulation (FAR) Part 10, market research was conducted to arrive at the most suitable approach to acquiring Medtronic NIM Nerve Monitoring System for the VA PAHCS, Palo Alto, California. Market research indicates the requirement is a commercial item as define in FAR part 2.1. After searching General Service Administration (GSA)/Veterans Affairs (VA) Federal Supply Schedule (FSS) e-library, in guidance with priorities for use of Government supply sources (FAR part 8.003 (c)), it was determined the Medtronic NIM Nerve Monitoring System is not available on the schedule. Medtronic is the manufacturer of the NIM Nerve Monitoring System and is available in the commercial market place. 9.SUPPORTING FACTS: Extensive market research was conducted. Market research shows that Medtronic NIM is the latest product in the line of intraoperative neurophysiological monitoring (IONM) or intraoperative neuromonitoring systems available. In addition, the existing Medtronic NIM monitoring accessories are compatible with new system; therefore no additional costs are incurred to the Government and it minimizes waste. Furthermore, maintaining Medtronic NIM ensures user ease, training and maintenance resulting in continuity of surgical procedures and standardization at the VA PAHCS for all clinical staff. 10.LISTING OF SOURCES: There are currently no other sources who have expressed interest in this acquisition. 11.STATEMENT OF ACTION: Notification of the proposed procurement will be placed on Federal Business Opportunities (FBO) in accordance with FAR 6.305. 12.TECHNICAL SUPPORTING DATA: The software used is proprietary to Medtronic. 13.CONTRACTING OFFICER: I certify the supporting data under my cognizance which are included in the J&A are accurate and complete to the best of my knowledge and belief.
