- This action has been awarded under the American Recovery and Reinvestment Act(ARRA) of 2009. In compliance with this Act, the Government posts this notice that TaskOrder (TO) 41 Revision 1 was issued under contract NNJ08JB01C, the EnvironmentalContract, to decrease the task order value due to contractor efficiencies. In addition,modification 120 was issued to deobligate excess funds that were funded by the RecoveryAct for Task Order 41. <P>The Environmental Contract was awarded on a competitive basis. These Task Orders wereissued under the cost-type contract arrangement in accordance with the contract. Acost-type arrangement is appropriate due to uncertainties involved in contractperformance that do not permit costs to be estimated with sufficient accuracy to use anytype of fixed-price contract. In addition, a cost-type contract was selected to providethe contractor the greatest incentive for efficient and economical performance, given thetypes of services to be performed. This Environmental Contract has experienced personneland documented performance to mitigate the Government's risk. In order to meet therequirements of the Recovery Act in the most prudent business manner, with the timeconstraints imposed, the existing Environmental Contract is the most appropriatecontractual vehicle for the work required.
