- Amendment 1 - Questions and Answers are provided in response to solicitation as follows: 1. Is the USPTO requesting a voucher-type program, meaning the administrator would not be required to process claims? If so, can a vendor also propose an alternate solution that includes claims processing? The USPTO is not requesting a voucher-type program. The USPTO intends to use salary reduction agreements. The USPTO will not reimburse employees for parking expenses on a cash basis. 2. Can the responders provide a list of references for contact as outlined in the Technical evaluation factors section rather than working through the Open Ratings process? Or, as another option, could a letter from the reference be included with the RFP response in addition to the list to meet the requirement? No, the USPTO has chosen Open Ratings, Inc. to conduct past performance evaluations. This requirement will not be changed. Changing the past performance evaluation method at this time would require a revision in the Request for Proposal which would affect many other aspects of this acquisition. 3. Can the E-verify be completed post-award? If the Contractor is not enrolled as a Federal Contractor in E-Verify at the time of contract award, the Contractor must enroll within 30 calendar days of contract award. For each employee assigned to the contract, initiate verification within 90 calendar days after date of enrollment or within 30 calendar days of the employee's assignment to the contractor, whichever date is later. Please refer to the RFP, Section H.17 52.222-54 Employment Eligibility Verification (Jan 2009) for specific information. 4. What is the impact of a responder not being able to provide a list of terminated clients due to confidentiality? The Government could consider this a risk to successful performance of the contract. The Government is required to consider past performance in its evaluations. The Offeror will be given the opportunity to explain any negative or adverse information which the Government receives.
