Description
Justification for Other than Full and Open Competition Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of 41 U.S.C. 253 ( c )(1) and FAR 6.302-1. 1. Contracting Activity Department of Veterans Affairs Employee Education System #1 Jefferson Barracks Dr, Bldg 50 RM 1N76 St Louis Mo 63125 2. Nature of Action Being Approved: This justification and approval Sole Source procurement, with National Fire Protection Association, 1 Batterymarch Park Quincy, MA 02169-7471. The proposed contract cost is estimated to be $70,495.00. 3. Description of Service and Supplies: The purpose of the contract is to obtain: A)Subject matter expertise including knowledge and scripting of instruction of the most current version (2011 Edition) of National Electrical Code (NFPA 70) including but not limited to: "Define the organization of NFPA 70 and its general requirements "Wiring and protection issues "Wiring methods and materials "Equipment for general use "Special Occupancies "Special Equipment "Communications Systems "Tables and Safety Standards "Types of construction (including health care and other occupancies) "Availability and reliability for Critical Operations Power Systems "Development and Implementation of Functional Performance Tests for Critical Operations Power Systems "Supervisory Control and Data Acquisitions "Administration and Enforcement B)Subject matter expertise including knowledge and scripting of instruction of the most current version of Inspection, Testing and Maintenance of Fire Alarm Systems (2011 Edition) (NFPA 25) including but not limited to: "Locate and explain the scope, purpose, definitions and reporting requirements of the current edition of NFPA 25 " Recognize the requirements and procedures for the inspection, testing, and maintenance of private service mains, common valve components, system valves, and sprinkler and standpipe systems "Plot flow test results to determine causes of water supply problems "Evaluate system test data "Differentiate between the types of storage tanks and their inspection and safety concerns " Identify water spray, foam-water, and foam-water spray systems "Restore obstructed piping "Recognize the importance of having a procedure to deal with system impairment This contract will be executed in three phases during the period of August through March 2011. It also includes substantive copyrighted instructional materials and textbooks that are solely available from the National Fire Protection Association. These materials are specific to adopted codes which the VA and VHA have taken as standard operating practices and methods of operations. The proposed contract cost is estimated to be $70,495.00. 4. Statutory Authority: The statutory authority of this justification is FAR 5. Rationale Supporting Use of Authority Cited Above: The only firm able to meet Department of Veterans Affairs (VA) requirements is the National Fire Protection Association. Their experience working with interested bodies in the development of fire protection codes led to their being placed in the unique position of being best able to assist VA by providing the instructional tools, methods and textbooks. Furthermore, the instruction and standards have been validated by the internationally recognized process of standards formation is subject to rigorous review by VHA and other healthcare participants. NFPA Standards are the officially recognized standards for VA and VHA fire protection and construction. Other vendors may be able to provide the instruction for the course. However, if other vendors were used, that would require said vendors to purchase textbooks for the courses under contract from the National Fire Protection Association yielding cost markups. Purchasing the instruction, texts, and instructional materials from the National Fire Protection Association provides for cost reductions in the overall contract and cost savings for the Federal Government. Another vendor would pay the same price as the Federal Government for the textbooks used for the course. Once acquired, the books would typically receive a mark up fee of 15% to 30%. This would yield a cost savings of $3577.50 to $7155.00 for the Federal Government. 6. Description of Market Research: No efforts were made to solicit other offerors. Any instructional provider would require purchase of materials at a greater cost to the Government due to sub-contracting of purchasing books and other materials directly from the NFPA and associated markups in cost. The proposed vendor is not available on GSA schedule. 7. Determination of Fair and Reasonable. Another vendor would pay the same price as the Federal Government for the textbooks used for the course. Once acquired, the books would typically receive a mark up fee of 15% to 30%. This would yield a cost savings of $3577.50 to $7155.00 for the Federal Government. 8. Other Supporting Data: N/A (previous awards) 9. Other Interested Sources: None 10.Future barriers to competition: This is a contract for one year. 11.
