- Justification for Other Than Full and Open Competition (JOFOC) Document The following Justification for Other than Full and Open Competition is prepared in accordance with Federal Acquisition Regulation (FAR) Part 6.302-1 (a) (2) Only one responsible source / no other supply will satisfy agency requirement and the Department of Veterans Affairs Acquisition Regulation (VAAR) 806.304-1 the justification will be reviewed and approved by the Contracting Officer. 1. Agency Identification New Mexico VA Health Care System (NMVAHCS) 1501 San Pedro Dr SE Albuquerque, NM 87108 2. Description of Action Being Approved This Justification for Other than Full and Open Competition (JOFOC) comes as a result of a pressing requirement at the NM VA HCS for the only complete maintenance and repair service for the intermittent problem with Philips iE33 Ultrasound system. Cardiology Echo has four of these with each having this problem. In accordance with FAR 6.301-1 (a) (2), Only one responsible source and no other supplies or services will satisfy agency requirements. To have this maintenance and service performed on the NMVAHCS will benefit the veteran population as follows: Equipment was purchased from Philips Medical Systems North America INC. with no maintenance services and is the only company authorized to provide technicians to maintain it at this time. The company manufactures these machines and has proprietary and no other company has company authorization to maintain and repair. 3. Description The problem is caused by the operation control panel switches that will intermittently fail causing the system to lockup. The lock forces a shutdown before operation can restart. The forced shut then causes a loss of patient image data. Bio-Med repairmen do not have the expertise to maintain the equipment and keep them up to national standards. 4. Statutory Authority/Authority Cited The basis of this JOFOC is the criteria implemented in the Federal Acquisition Regulation (FAR) Part 6.301-1 (a) (2) Only one responsible source / no other supply will satisfy agency requirement and the Department of Veterans Affairs Acquisition Regulation. (a) Authority. (1) Citations: 10 U.S.C. 2304 (c) (1) or 41 U.S.C. 253 (c) (1). (2) When the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. 5. Reason for Authority Cited The reason for citing FAR Part 6.301-1 (a) (2) as the statutory authority for this JOFOC is that it is appropriate in this situation where the agency ™s needs could only be satisfied by the unique supply available through Philips Medical Systems North America INC. Application: This authority applies in those situations where ” (1) The only company that maintains and services this equipment (2) Philips Medical Systems North America INC. builds and maintains the equipment and has proprietary ownership (3) Delay in award of a contract would result in serious injury, financial or other, to the Government. 6. Demonstrate Proposed Contractor ™s Responsible and Reliable Source The following are some of the details that make the Maintenance and repair service from Philips Medical Systems a responsible and reliable source: Philips Medical Systems North America INC. builds and provides repair on equipment It is the only one that offers 24/7 maintenance and repair service for their equipment Equipment was purchased from Philips Medical Systems North America INC Company has proprietary ownership of equipment and software 7. Sources Sought Efforts. This agency has completed research using the VetBiz Registry sources for similar manufacturers. The search resulted in no other companies available that sell or maintain these ultrasound equipment used at this facility. 8. Determination of Fair/Reasonable Price. Price reasonableness will be established in accordance with FAR 13.106.3 using other current and previous contract prices. 9. Description of the Market Research Conducted and Results. Research conducted reveals Philips Medical Systems North America INC. as the only company which provides Maintenance and Repair services on this equipment. Equipment was purchased from Philips Medical Systems North America INC. therefore due to proprietary ownership has to be maintained by same.
