Description
It is the intent of the Missile Defense Agency (MDA) to issue up to three sole source solicitations to Lockheed Martin Space Systems Company (LMSSC), P.O. Box 3504, Sunnyvale, California 94088-3504 to manufacture and deliver up to three (3) Terminal High Altitude Area Defense (THAAD) Systems as Foreign Military Sales (FMS) requirements. The first of the three FMS requirements is in support of the United Arab Emirates (UAE). The solicitation requirements will include the Engineering and Logistics Support necessary to field the THAAD Ballistic Missile Defense System (BMDS). The THAAD system is comprised of the following components: Missile, THAAD Fire Control and Communications (TFCC), Launcher, and Peculiar Support Equipment (PSE). The three (3) FMS THAAD Systems, the first of which is for UAE, are anticipated to consist of nine (9) Launchers, one hundred forty-four (144) Missiles, three (3) THAAD Fire Control Communication Units (TFCC), and three (3) Battery Support Centers. In addition to engineering, logistics and technical support, the solicitation requirements will also include: software, software support, training, spares, and assorted technical publications. All THAAD components will be delivered to the FMS customer and integrated into an operational weapon system. The proposed acquisition will be sole source to LMSSC pursuant to the authority of FAR 6.302-1(a)(2)(ii) & (iii) as the resulting follow-on contracts are for the continued provision of highly specialized supplies and services where it is likely that award to any other source would result in substantial duplication of cost and unacceptable delays of the requirement. LMSSC has been the prime sole-source contractor on two previous THAAD System developmental efforts under Contracts DASG60-92-C-0101 and DASG60-00-C-0072. The initial production contract to manufacture and supply THAAD Fire Units 1 & 2, HQ0147-07-C-0196, was awarded sole-source to LMSSC on 22 December 2006. On 25 August 2008, the Missile Defense Agency approved the sole-source purchase of additional Fire Units from LMSSC. The Government is currently in negotiations with LMSSC for these Fire Units. On 27 August 2008, the MDA approved the sole-source acquisition of field support and services from LMSSC. The field support and services contract, HQ0147-10-D-0001, was awarded to LMSSC on 31 March 2010. Only LMSSC is capable of manufacturing the identified THAAD components and integrating them into fire units and providing field support without substantial duplication of cost and unacceptable delays in fulfilling the agency’s requirements. See Note 22. Note 22 Reads: The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability by responding to this requirement. This notice of intent is not a request for competitive proposals. However, all information received within sixty days after date of publication of this synopsis will be considered by the Government. Any party interested in this requirement should contact this office within 15 days after publication of this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
