Description
This is not a request for competitive proposals, but instead a market research method to determine interested sources. The United States Department of Agriculture (USDA), Agricultural Marketing Service (AMS), Livestock and Seed (LS) Program is responsible for the development, implementation, and enforcement of the Country of Origin Labeling (COOL) law that requires retailers, such as full-line grocery stores, supermarkets, and club warehouse stores, to notify their customers with information regarding the source of certain foods. Covered commodities identified in the law include muscle cuts and ground meats (beef, veal, pork, lamb, goat, and chicken); wild and farm-raised fish and shellfish; fresh and frozen fruits and vegetables; peanuts, pecans, and macadamia nuts; and ginseng. The regulation for fish and shellfish covered commodities (7 CFR Part 60) became effective in 2005. The final rule for all remaining covered commodities (7 CFR Part 60 and Part 65) went into effect on March 16, 2009. In order to perform these functions, the USDA needs to obtain retail store information for all physical locations of retail facilities that are licensed under the Perishable Agricultural Commodities Act (PACA) of 1930. One of the criteria of a PACA licensee is an aggregate annual purchase of fruits and vegetables over $230,000 per year. These retail facilities are the population of retail stores that the USDA is authorized to review to ensure compliance with the COOL law by retailers and suppliers. There is an estimated total population of 45,000 retail facilities nationwide. Interested sources would need to provide retail store information such that the USDA will have a complete and true database of the retail facility population in the United States, and be able to update that database with any store openings and closings on a fiscal year basis. Multiple but minor information requests throughout the fiscal year may be needed when changes in the database occur. Interested sources would need to maintain historical data of retail store listings previously provided to the USDA so as to minimize repeating any information previously transmitted. Interested sources would need to provide the physical location of qualified retail stores. The following retail information would be required: a) Store location information: • Store Name • Store ID Number (if applicable and if available) • Store Phone Number • Store Address that includes street name, city, state, zip+4, county, and shopping center location. • Corporate Name and Address (if applicable and if available) • Weekly Volume Sales b) Interested sources would need to maintain and separate the retail store database into supermarkets and club stores in which the aggregate annual grocery sales exceed $2 million per year. c) Interested sources would need to collect, manage, and analyze data for qualified retail stores. d) Interested sources must have legal access to the above information. e) Interested sources must be knowledgeable, experienced, and capable in providing all the above information, in addition to having the capability to maintain a historical database to avoid duplications for any future requests. f) The retail store list must be provided by email or on a CD in an MS-Excel format. Interested sources that are capable of providing all of the above information are encouraged to submit statements of capability to the contracting office. Small Business concerns are especially encouraged to participate. This is not a request for competitive proposals, but instead a market research method to determine interested sources. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No requests for capability briefings will be honored as a result of this notice. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. Please provide Tax I.D.
