- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IAW FAR 6.303(a)(1-12): 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs Great Lakes Acquisition Center 5000 W National Avenue Bldg 5 Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract to Renovate Building 109, Women's Health at the Clement J. Zablocki VA Medical Center, Milwaukee, Wisconsin. 3.A description of supplies/services required: Provide materials and labor to remodel an existing residential duplex building into office spaces including exam rooms and larger group meeting rooms with lavatory, a kitchenette, and a 2-stop pedestrian lift. Work includes removing all existing partitions, one stairway from the basement to the second floor, cabinetry, finishes, plumbing and lighting fixtures, as well as heating and cooling systems. Add new partitions, doors and hardware, plumbing and lighting fixtures, furnishings, pedestrian lift from the first to the second floor, an exterior exit stairway with landing from the second floor to grade, data/com outlets, site work concrete, piping/ductwork/flooring/ceiling, duct insulation, floor finishes, rough carpentry, finish carpentry, etc. 4.Statutory authority permitting other than full and open competition: Public Law 109-461 and FAR 6.302-5, Authorized or Required by Statute. 5.Facilities Unique Qualifications: None 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: Not Applicable. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated award price of the contract between $250,000 and $500,000 will exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal Procurement Policy Act (41 U.S.C. 403); and in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. 8.Market survey conducted: The concern N2 Construction LLC is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database, available at www.VetBiz.gov. A review of N2 Construction LLC; capability/profile information revealed that they have the experience, expertise and bonding level to perform the scope of work outlined in this project. N2 Construction LLC is determined to be a responsible source with respect to performance of such contract opportunity.
