- Document Type: Combined Synopsis/Solicitation Classification Code: 42 Safety Equipment NAICS Code: 315999 - Other Apparel Accessories and Other Apperel Manufacturing The United States Department of Commerce, National Weather Service's intends to award on a sole source basis, under authority of Federal Acquisition (FAR) 6.302 Other Than Full and Open Competition to Sperian Protection for fall protection equipment identical to the existing, currently stocked equipment at the National Logistics Support Center in Kansas City, MO. The acquisition of the same fall protection equipment is crucial for a successful continuation of fall protection training and maintenance/replacement of existing fall arrest systems to assure that the National Weather Service's fall protection training program is consistent, provides standardized equipment, and conveys the same instructions to all existing and new climbers. It is the past experience with the fall protection program that the use of standardized equipment ensures National Weather System climbers correctly apply the knowledge of fall arrest systems and climbing techniques learned in training classes. The existing fall protection equipment used by The National Weather Service's was selected as a complete fall arrest system that consists of 5 basic compatible components. The selection of the most suitable fall protection equipment as required by 29 CFR 1926.500 was based on several criteria's such as system function, fit, form, durability, and on recommendation from NWS field personnel who tested the equipment. If different fall protection equipment is purchased, the components of the existing fall arrest systems owned by NWS climbers and the existing stock, may not be compatible with the new ones, and cannot be simply interchanged. Therefore, if different fall protection equipment is purchased it will increase the risk of climbing mishaps/accidents and escalate equipment replacement and maintenance costs. It could also result in substantial increase and duplication of training costs. As mandated by the Occupation Safety and Health Administration fall protection regulation 29 CFR 1926.502(a) (2) and the NWS safety procedures "Fall Protection" the Government (NWS) must provide personal fall protection equipment for all employees who are expected to climb as a part of their job (active climbers) and equipment specific hands-on training, and therefore uninterrupted NWS operations and mission. The following items listed were selected and matched to provide for a complete fall arrest system with compatible connectors and to be suitable for all structures and climbing scenarios that NWS climbers should encounter at NWS facilities. Due to technical program requirements and compatibility issues, the items specified below may not be substituted with any like or similar items. Adjustable from 4 to 6 ft Miller Carabiner 1" gate, Miller 17D-1 a. Compatible with system connectors Miller Carabiner 2" gate, Miller 18D-1 a. Compatible with the system connectors The required delivery date is September 30, 2010. Vendors who believe they have the ability to meet the unique technical and capability features are required to submit in writing an affirmative response demonstrating that they can meet the Government requirements. The response must be sufficient to permit agency analysis to establish bona fide capability to meet the requirements. Failure to submit sufficient documentation will result in the Government proceeding as stated above. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely with the discretion of the Government.
