- The U.S. Army Contracting Command, Joint Munitions & Lethality Contracting Center, Picatinny Arsenal, NJ 07806-5000, on behalf of PM Soldier Weapons, intends to solicit, negotiate and award a sole source contract to Kongsberg Defence & Aerospace(KDA) under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(ii)(B). The anticipated effort is to modify the Counter Sniper Interface in the Common Remotely Operated Weapon Station(CROWS) produced by KDA. Software modifications are needed to correct the vulnerabilities and coding errors in the Counter Sniper software interface.KDAs CROWS are a proprietary design; no other contractor could provide the necessary modifications without obtaining KDAs proprietary data. Without the authority to redistribute the software source code, no other entity will possess the understanding or the ability to modify the code to address the issues in the software. The additional expenses and delays to have another contractor gain the detailed understanding and rights necessary to perform this task is considered to be unacceptable. Please note that this notice does not constitute a Request for Proposal. A determination by the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government. The anticipated award date for this action is 24 Sept. 2010.
