- SCHEDULE OF SUPPLIES/SERVICES AND PRICES/COSTS (SF 1449, Continuation of Blocks 19 - 24) Under the authority of Public Law 104-262 and 38 USC 8153, the contractor agrees to provide Health Care Resources in accordance with the terms and conditions stated herein, to furnish to and at the Department of Veterans Affairs (VA) medical facilities, the services and prices specified in the Section entitled Schedule of Supplies/Services of this contract. If you are providing an alternate pricing schedule, the Standard Form (SF) 1449, page one of the solicitation, and Clause 52.212-3, Offeror Representations and Certifications - Commercial Items (MAY 2001) must be completed as well as documentation for the alternate pricing. All quotes must be accompanied by a technical proposal as instructed herein. Any questions concerning this solicitation should be submitted to the contracting officer in writing by mail or fax. [End of Schedule of Supplies/Services and Prices/Costs] STATEMENT OF WORK 1.Contractor to provide mammography exams as requested by the veteran's administration on an as needed basis. 2.Turnaround time for performing routine cases: within forty-eight hours.. 3.Turnaround time for performing emergency or STAT cases: same day or next day. 4.Written reports for routine cases will be faxed to the VA contact person within 24 hours of when the case was performed. 5.Written reports for emergency or STAT cases will be dictated and (faxed and/or phoned) to the VA contact person within 12 hours of when the study was performed. 6.STAT and/or emergency cases will be identified as such on the prescription form. 7.Contractor shall maintain documentation of employee competency. 8.Contractor shall provide evidence of appropriate license and liability insurance. 9.Facility is compliant with mammography quality standards act (MQSA). 10.Ms. Monica Brandon will be the VA contact person responsible for scheduling exams and receiving x-ray reports. 11.Ms. Brandon's mailing address is: Monica Brandon, Women Veteran's Program Clerk (111), Department of Veterans Affairs Medical Center, 1400 Blackhorse Hill Road, Coatesville, PA 19320. Ms. Brandon's phone number is (610) 384-7711, extension 3371. 12.Screening mammogram; see above description and pricing. 13.Breast Ultrasounds, and related reports, as determined by the contract radiologist. 14.Breast tissue biopsies, and related reports, as determined by the contract radiologist. SPECIAL CONTRACT REQUIREMENTS Under the authority of Public Law 104-262 and 38 USC 8153, the contractor agrees to provide Health Care Resources in accordance with the terms and conditions stated herein, to furnish to and at the Department of Veterans Affairs (VA) medical facilities, the services and prices specified in the Section entitled Schedule of Supplies/Services of this contract. 1. SERVICES: a. The services specified in the Sections entitled Schedule of Supplies/Services and Special Contract Requirements may be changed by written modification to this contract. The VA Contracting Officer will prepare the modification. b. Other necessary personnel for the operation of the services contracted for at the VA will be provided by the VA at levels mutually agreed upon which are compatible with the safety of the patient and personnel and with quality medical care programming. c. The services to be performed by the contractor will be performed in accordance with VA policies and procedures and the regulations of the medical staff by laws of the VA facility. d. The VA Chief of Staff or designee may provide professional direction to the contractor and/or the contractor's employee(s). e. There is no employer-employee relationship between the VA and the contractor or the contractor's employee(s). 2. TERM OF CONTRACT: This contract is effective for a period of one year from the date of award (with four one-year options, exercised at the government's discretion). The contract is subject to the availability of VA funds. The contractor shall perform no service after September 30th, each year, until the contracting officer authorizes such services in writing. 3. QUALIFICATIONS: Personnel assigned by the Contractor to perform the services covered by this contract shall have required education and experience qualifications. Contractor's employees are required to be proficient in spoken and written English (38 USC Chapter 74). 4. National Holidays: The 10 holidays observed by the Federal Government are: New Year's Day (January 1st), Martin Luther King's Birthday (3rd Monday in January), Presidents' Day (3rd Monday in February), Memorial Day (last Monday in May), Independence Day (July 4th), Labor Day (1st Monday in September), Columbus Day (2nd Monday in October), Veterans Day (November 11), Thanksgiving Day (4th Thursday in November), Christmas Day (December 25th) and any other day specifically declared by the President of the United States to be a national holiday. When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday by U.S. Government agencies. 5. PERSONNEL POLICY: The contractor shall be responsible for protecting the personnel furnishing services under this contract. To carry out this responsibility, the contractor shall provide the following for these personnel: "Workers compensation "Professional liability insurance "Health examinations including: a. Annual TB Skin Test and recent (within the last year) chest X-ray if there is a history of positive TB skin test, b. Evidence of Hepatitis B immunity (hepatitis immune titer, if provider has had the series of shots; if no immunity, evidence that provider has started the Hepatitis B vaccination series.), c. Evidence of a Hepatitis C titer, d. Varicella titer if provider has not had chicken pox. "Income tax withholding, and "Social security payments. The parties agree that the contractor, its employees, agents and subcontractors shall not be considered VA employees for any purpose. 6. RECORD KEEPING: The VA shall establish and maintain a record keeping system that will record the procedures completed by the contractor's employee(s). After contract award, any incidents of contractor noncompliance as evidenced by the monitoring procedures shall be forwarded immediately to the Contracting Officer. 7. HHS/OIG To ensure that the individuals providing services under the contract have not engaged in fraud or abuse regarding Sections 1128 and 1128A of the Social Security Act regarding federal health care programs, the contractor is required to check the Health and Human Services - Office of Inspector General (HHS/OIG), List of Excluded Individuals/Entities on the OIG Website (www.hhs.gov/oig) for each person providing services under this contract. Further the Contractor is required to certify in its proposal that all persons listed in the contractor's proposal have been compared against the OIG list and are NOT listed. During the performance of this contract the Contractor is prohibited from using any individual or business listed on the List of Excluded Individuals/Entities. 8. CONFIDENTIALITY OF PATIENT RECORDS When VA is providing services involving patient records to non-Federal entities, the records maintained by VA in providing those services are subject to the Privacy Act, FOIA, and other VA specific laws regarding the confidentiality of patient records. The party to whom VA is providing the services will want to review those records in order to ensure that VA is providing quality care in accordance with the contract. In order for VA to be able to release those records the following language applies: The Sharing Partner is a VA contractor and will assist in the provision of health care to patients seeking such care from or through VA. As such, the Sharing Partner is considered as being part of the Department health care activity. Sharing Partner is considered to be a VA contractor for purposes of the Privacy Act, Title 5 U.S.C. 552a. Further, for the purpose of VA records access and patient confidentiality, Sharing Partner is considered to be a VA contractor for the following provisions: Title 38 U.S.C. 5701, 5705, and 7362. Therefore, Sharing Partner may have access, as would other appropriate components of VA, to patient medical records including patient treatment records pertaining to drug and alcohol abuse, HIV, and sickle cell anemia, to the extent necessary to perform its contractual responsibilities. However, like other components of the Department, and not withstanding any other provisions of the sharing agreement, the Sharing Partner is restricted from making disclosures of VA records, or information contained in such records, to which it may have access, except to the extent that explicit disclosure authority from VA has been received. The Sharing Partner is subject to the same penalties and liabilities for unauthorized disclosures of such records as VA. The records referred to above shall be and remain the property of VA and shall not be removed or transferred from VA except in accordance with U.S.C.551a (Privacy Act), 38 U.S.C. 5701 (Confidentiality of claimants records), 5 U.S.C. 552 (FOIA), 38 U.S.C. 5705 (Confidentiality of Medical Quality Assurance Records) 38 U.S.C. 7332 (Confidentiality of certain medical records) and federal laws, rules and regulations. Subject to applicable federal confidentiality or privacy laws, the Sharing Partner, or their designated representatives, and designated representatives of federal regulatory agencies having jurisdiction over sharing partner, may have access to VA 's records, at VA's place of business on request during normal business hours, to inspect and review and make copies of such records. 9. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical, professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment), in accordance with Federal Acquisition Regulation (FAR) 37.401(b). The contractor shall have a written quality assurance plan which includes the following: 1) providing documentation that a quality control program is designed and implemented that minimizes patient and public risks and maximizes the quality of services. 2) assuring that a qualified physician, or other qualified individual monitors the provision of services. The contractor's Quality Assurance Plan shall be reviewed by the VA Medical Center. Any deficiencies shall be corrected within thirty (30) working days after written notification from the Contracting Officer to assure compliance with VA Quality Management Programs. The contractor agrees to comply with peer review, risk management, satisfaction, staff competencies, etc. activities. This data should be submitted quarterly to the A.O. to the Chief of Staff and COTR through the Office of the Chief of Staff. The contractor will work with the COTR and Quality Improvement staff to determine indicators for Joint Commission review that will reflect the quality of care being provided. The contractor must meet the VA standards for turn-around time for services. The contractor's facilities, methodologies (protocols), and quality assurance protocols must be provided to the representatives of the VA every six months (March & September) for the life of the contract. It will be reviewed by Coatesville VAMC's Quality Improvement office which reserves the right to require quality reports and action plans at any time during the life of the contract 10. The Joint Commission AND OTHER SPECIAL REQUIREMENTS The Joint Commission (TJC) standards are separate from clinical standards; therefore, this language does not apply to Physicians who are Credentialed and Privileged) The Contractor will be responsible to ensure that Contractor employees providing work on this contract are fully trained and completely competent to perform the required work. The Contractor is required to maintain records that document competence/performance level of Contractor employees working on this contract in accordance with TJC and other regulatory body requirements. The Contractor will provide a current copy of the competence assessment checklist and annual performance evaluation to the Contracting Officer's Technical Representative (COTR) for each Contractor employee working on this contract. Where the contract does not require TJC accreditation or other regulatory body requirements, the Contractor must perform the required work in accordance with JCAHO standards. A copy of these standards may be obtained from the Joint Commission on Accreditation of Healthcare Organizations, One Renaissance Blvd., Oakbrook Terrace, IL 60181. Where the contract does not require TJC accreditation or other regulatory requirements regarding worker competency, the Contractor must perform the required work in accordance with TJC standards. The contractor is required to develop and maintain the following documents for each Contractor employee working on the contract: credentials and qualifications for the job; a current competence assessment checklist (an assessment of knowledge, skills, abilities and behaviors required to perform a job correctly and skillfully; includes knowledge and skills required to provide care for certain patient populations, as appropriate.); a current performance evaluation supporting ability of the Contractor employee to successfully perform the work required in this solicitation; and listing of relevant continuing education for the last two years. The Contractor will provide current copies of these records at the time of contract award and annually on the anniversary date of contract award to the VA COTR, or upon request, for each Contractor employee working on the contract. 10. KEY PERSONNEL AND TEMPORARY EMERGENCY SUBSTITUTIONS: The Contractor shall assign to this contract the following key personnel: Physicians qualified to provide professional mammography services. a. Physicians providing the professional services must be credentialed at the Coatesville VA Medical Center. [End of Statement of Work/Special Contract Requirements]
