Description
AMENDMENT #2 TO SYNOPSIS/SOLICITATION #DJJ-APG-10-L-072 Question: Can you please clarify how the price is to be made to you? As you know that bid is calling for FOB Destination for ULSD red dyed fuel. Prices for fuel changes daily and in some cases hourly. Would you accept the average daily OPIS + freight + differential + taxes (if any) = delivered price? Or would you just take our differential (this assumes that the DJP knows the daily market price)? Answer: Each offeror must submit a firm fixed price quote as stated in the synopsis/solicitation. The firm fixed price shall include the unit price per gallon and the total firm fixed price for the 25,000 gallons of ultra low sulfur diesel fuel. An offeror shall use their own discretion in determining a fair and reasonable price for the government's requirement, but the following information is provided for questions concerning Freight and Tax charges: F.O.B. Destination Means free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and supplies shall be delivered to the destination consignee's facility at the expense of the contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery of the supplies to the destination, unless such charges are caused by an act or order of the Government in its contractual capacity. The contractor is responsible to pay and bear all charges to the point of delivery. Taxes Federal Excise Tax - Diesel fuel can be clear or dyed red. Red Diesel is for off-road use only and is not taxed. It powers off-highway equipment, stationary equipment, and heats homes, offices and shops. The requirement is for red dye, ultra low sulfur diesel fuel, for off-highway business use. State and Local Taxes - Generally, purchases and leases made by the Federal Government are immune from State and local taxation. ANTICIPATED AWARD DATE: An award will be issued by no later than September 9, 2010. The following FAR Clause is incorporated by reference: FAR 52.247-34 F.O.B Destination (NOV 1991) All other terms and conditions of Solicitation #DJJ-APG-10-L-072 will remain unchanged.
