Description
Notice of Intent for Procuring Open Market Items The Department of Interior, National Business Center, Acquisition Services Directorate (AQD), on behalf of the U.S. Consumer Product Safety Commission (CPSC), intends to award a Purchase Order to procure open market items under the authority of FAR Part 13.106-1(b), Soliciting from a Single Source using Simplified Acquisition Procedures under FAR Part 13.5 - Test Program for Certain Commercial Items. The open market items are to provide an Inductively Coupled Plasma - Mass Spectrometer (ICP-MS) from Bruker Daltronics. The Government's entire requirement includes: the Bruker 820-MS Spectrometer Three Phase 208V version furnished with a 10 foot cord and a type 15-30P plug to match the receptacle at the installation site, all the parts necessary for full functionality of the ICP-MS, installation in the CPSC laboratory and calibration by a qualified engineer, and three (3) days of user training. The specific items in this requirement had been distributed by Varian until recently when Varian's ICP-MS business was acquired by Bruker Daltronics (Bruker) in its newly established Chemical Analysis division which is now the sole distributor. The Government anticipates awarding a Firm Fixed Priced Purchase Order. Competition is not available as the ICP-MS must be compatible with, and interoperable with, CPSC's current Varian ICP-Optical Emission Spectrometer (ICP-OES). The Bruker ICP-MS and CPSC's existing ICP-OES utilize the same software platform and many of the parts, consumables and accessories are interchangeable. Interoperability will allow CPSC staff to utilize and maintain the Bruker ICP-MS with minimal training. Interchangeable parts and supplies can be transferred as necessary to maintain continuity of operations. Common parts and supplies will also minimize maintenance inventories. ICP-MS capabilities are required to complement and expand upon the existing ICP-OES capabilities by increasing peak throughput and by providing an alternate detection technology for confirmatory analyses and for analyzing samples with spectral interferences. The ICP-MS will allow CPSC to measure specific isotopes (e.g. chromium-VI) and will yield detection limits 1,000 times lower than the ICP-OES. Lower limits are needed to keep up with ever decreasing regulatory levels. Since the Varian ICP-MS line is now distributed exclusively by Bruker, Bruker is the only vendor found that can meet the requirements. A Request for Quotation (RFQ) package is not available. The NAICS code for this requirement is 334516, Analytical Laboratory Equipment and the Size Standard is 500 Employees. However, this acquisition is being awarded on an unrestricted basis. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Contracting Officer. AQD will not be responsible for any costs incurred by an interested party responding to this notice. This notice in no way obligates the Government to award a Purchase Order.
