- J&A JUSTFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Agency; Southern. Region Contracting Office - West, Fort Sam Houston, Texas 78234-6000. 2. Description of Action: Request approval to solicit a sole source acquisition as outlined in FAR 6.302-1, for maintenance services from Abbott Medical Optics Inc. (AMO), for the Government owned INTRALASE Laser System. The INTRALASE Laser System is located at Carl R. Darnall Medical Center, Fort Hood, TX. This action will be accomplished through the use of a firm-fixed price contract. 3. Description of Products: The INTRALASE laser system is used by the Ophthalmologist on a per procedure basis. This system was developed and owned by AMO Inc, and is proprietary. The INTRALASE Laser System gives the surgeons the ability to gather precise and specific information from the patients' cornea, and create a custom cut flap on the cornea. This technology results in faster healing and recovery rates after LASIK surgery than standard methods of creating the protective flap, minimal risk of sight-threatening events (free caps, globe penetration, buttonhole flaps, decentered flaps, and/or incomplete cuts), no risk of corneal abrasion and reduced risk of dry eye in patients. Laser surgery is the most common form of refractive surgery today. AMO has the only authorized and certified technicians to service this equipment. 4. Authority Cited; The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (I), as authorized by Federal Acquisition Regulation (FAR) 6.302-1;Only one responsible source and no other supplies will satisfy agency requirements. 5. Reason for Cited Authority: The Government Owned INTRALASE laser system may only be service by AMO authorized and certified engineer technicians according to Ms. April Bachman, Government Accounts, at 877 266-4543. AMO is currently the sole authorized distributor of the interface packs used with Intralase Laser System. As the sole authorized distributor for the leading developer and manufacturer of the INTRALASE laser system and patient interface packs, AMO is the only known source that has the ability to provide maintenance, and if necessary, perform modifications to the laser system in order to comply with changes in applicable laws and/or regulations. 6. Efforts to Obtain Competition: This action will be advertised on FedBizOpps with a notice of intent to award a sole source contract to one and only one responsible source, No other efforts to obtain competition will be made for this requirement. 7. Actions to Increase Competition: Future acquisitions will also be synopsized in FedBizOpps. When the current INTRALASE Laser System with patient interface packs becomes obsolete and the Government decides to re-procure this type of laser system the requirement will again be advertised in order to foster any potential competition. 8. Market Survey: Market research via the internet, and e-mail, indicates that there are no other companies that offer maintenance services for the INTRALASE Laser System due to the patent and proprietary ownership of this system by AMO Inc. 9. Interested Sources: To date, no other sources have expressed an interest in this requirement. 10. Other Factors: - The incumbent, AMO, reserves the proprietary right to maintain this equipment. AMO has demonstrated the ability to provide engineering technicians, with short notice, to perform maintenance and corrections when required since 23 April 08. Alv10's quick response has allowed the medical facility to maintain its level of productivity in the refractive surgery clinic. A sole-source contract is the most effective means of fulfilling this requirement.
