- JA10-246 LexisNexis 1. Contracting Activity:Mission and Installation Contracting Center Fort Belvoir, VA 22060 2. Description of Action: Renewal of Lexis Nexis subscription. 3. Description of Supplies/Services: The total estimated value of the proposed action is $196,701.00. Renewal of LexisNexis subscription for online legal research service. This service is used Agency-wide to provide virtually unlimited access to all legal, legislative, news, financial, and public records material to be used in support of the DCAA mission. 4. Authority Cited: 10 U.S.C. 2304 (c)(1) and FAR 8.405-6, Limited Source, Brand Name. 5. Reason for Authority Cited: The Defense Contract Audit Agency (DCAA) performs all necessary contract auditing for the Department of Defense (DoD) and provides accounting and financial advisory services to all DoD procurement and contract administration activities regarding the negotiation, administration, and settlement of contracts and subcontracts. DCAA also provides contract audit services to other government agencies on a reimbursable basis. Therefore, our auditors need access to the latest and most reliable information available in all aspects of accounting, finance, and auditing. In addition to providing us with standard legal, legislative, news, financial, and public records materials, Lexis-Nexis also provides us with access to the Commerce Clearing House (CCH) Government Contracts Library. Our auditors have relied on the CCH Government Contracts Library which includes the CCH Government Contracts Reporter and Contract Appeals Decisions (1956-current) Cost Accounting Standards Guide FAR Archives (1984-current) for a very long time and understand and trust the CCH data. LexisNexis is being used Agency-wide to provide virtually unlimited access to all legal, legislative, news, financial, and public records materials. This online access has proven to be an invaluable tool for our audit staff. The CCH addition to this service is only available from Lexis-Nexis. CCH is the largest and most comprehensive financial reporting online database for providing easy access to accounting, auditing, governmental and SEC authoritative literature and includes interpretive guidance written by experts in the field to help our auditors understand and comply with rapidly changing accounting, auditing, governmental and SEC standards. CCH also provides us with international and US business credit information and credit reports. While others may offer something similar to CCH, our auditors are familiar with CCH and the time involved in trying to learn another on-line system would be detrimental to their workload. 6. Efforts to Obtain Competition: LexisNexis is the proprietary owner of the LexisNexis services. There are no resellers of LexisNexis. LexisNexis is the only provider that can offer the type of legal research service we require through one site; otherwise, we would have to contract with numerous vendors in order to have access to all the data and reports we require. The LexisNexis software is proprietary. All auditors are already trained in using LexisNexis. 7. Actions to Increase Competition: LexisNexis is the proprietary owner of the LexisNexis services. There are no resellers of LexisNexis. LexisNexis is the only provider that can offer the type of legal research service we require through one site; otherwise, we would have to contract with numerous vendors in order to have access to all the data and reports we require. The LexisNexis software is proprietary. All auditors are already trained in using LexisNexis. 8. Market Research: DCAA conducted an analysis of its online research subscription services in 2002 and determined that LexisNexis not only offered the best value for the types of research our auditors use but was also the only one that could offer the CCH online access also. The DCAA project office continues ongoing market research to determine if any new products can satisfy DCAA's requirements. To date, no other sources have demonstrated the capability necessary to provide the combination of services, with the CCH database included, at this time. It is determined to be in the best interest of the Government to continue utilization of LexisNexis services. LexisNexis Advantages: Shepard's - LexisNexis is the exclusive provider of Shepard's Reports. Shepard's is the industry standard in case history and citation validation service for more than 130 years. Users can quickly and easily validate and update caselaw, administrative decisions, federal and state statutes, CFR, law reviews, ALRs and patents. CCH Materials - LexisNexis is the only online aggregator provider of CCH materials. One of the sources available is the CCH Government Contracts Reporter which is widely recognized as one of the most complete and comprehensive collections of federal contracts research material. This indispensable resource contains the full body of law and news relating to government contracts to help instantly pinpoint the information needed for specific contracts. The CCH Government Contracts Reporter covers the full text of all pertinent federal government contracting laws and regulations, including the current Federal Acquisition Regulation (FAR) and its supplements. Detailed, fully annotated explanations help interpret these official documents, which reflect more than 35,000 decisions from various federal courts, administrative boards, and the General Accounting Office. Matthew Bender - LexisNexis is the exclusive publisher of Matthew Bender analytical legal research. Researchers have full access to 500 publications and benefit from expert legal analysis from eminent professionals. Matthew Bender titles provide deep analysis and information on 53 areas of law in a flexible format to easily pinpoint sections of interest. CIS Legislative Histories - LexisNexis exclusively provides CIS Legislative Histories, which are prepared by Congressional Information Service (CIS) and include key U.S. Public Laws from first consideration through presidential signature. Abstracts of the hearings, reports, prints and documents cited in the Legislative Histories are also included in the compilation. LexisNexis Mealey Publications - LexisNexis is the only online provider of Mealey's Publications which provide timely, comprehensive reports on the most relevant issues facing the litigation community.
