Description
The U.S. Environmental Protection Agency (EPA) Region 4 issued this contract for soil remediation at the Tower Chemical Company Site, located in Lake County, Florida on 10/28/09 to Polu Kai Services, LLC. This requirement is funded under the American Recovery and Reinvestment Act (ARRA). Modification No. 18 to subject contract will be issued to require an estimated 700 Cubic Yards (CY) of drums and contaminated soil to be transported and disposed at a RCRA Subtitle C facility. This material is contained in nine (9) roll-offs (approximately 140 CY and a segregated soil pile estimated at 560 CY). The amount for the transportation and disposal of the drums and contaminated soil to a RCRA Subtitle C landfill is $379,810.00. The total amount obligated for this firm-fixed price contract is $4,165,945.00 The statutory authority permitting other than full and open competition relative to this requirement is 41 U.S. C. 253 (c) (1), Only One Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by paragraph 6.302-1 of the Federal Acquisition Regulation (FAR). The two areas where the nine roll-offs and the segregated soil pile are staged are intertwined with the on-going movement of the contractor's equipment that is completing the designed excavation and additional removal triggered by confirmation sampling. It is likely that award to any other source would result in (a) Substantial duplication of cost to the Government that is not expected to be recovered through competition and (B) Unacceptable delays in fulfilling the agency requirements. The justification for other than full and open competition document will be posted after the issuance of this modification in accordance with FAR 6.305
