Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. All responsible sources may submit an offer/quote which shall be considered. The solicitation number is HQ0566-10-Q-GYM MEMBERSHIP. The solicitation is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular, FAC 2005-44. This requirement is UNRESTRICTED. The contract line item numbers, quantities and units of measure are as follows: CLIN ITEM QTY UNIT OF ISSUE 0001 Fitness Membership (50 each) for 6 months 0002 (Option One) Fitness Membership (50) each for 6 months PLACE OF PERFORMANCE: Arlington, VA PERIOD OF PERFORMANCE: Base Period - October 1, 2010 through March 31, 2011. Option Period One - April 1, 2011 through September 30, 2011. Description of requirement for the items to be required: STATEMENT OF WORK Fitness Center Memberships for Business Transformation Agency, Military and Civilian Personnel REQUIREMENT: The contract shall provide physical fitness facilities for civilian and military personnel assigned to the Business Transformation Agency (BTA), 1851 South Bell Street, Arlington, VA. SCOPE : The government anticipates purchasing: 50 - Memberships for BTA Civilian and Military Arlington Personnel. Employees shall pay a portion of the membership fee directly to contractor. BTA will fund seventy five percent (75%) and the employee will pay directly to the contractor twenty-five percent (25%). SPECIFICATIONS : The contractor shall provide: Unlimited access will be provided to physical fitness facilities, qualified instructors, formal health programs and services. The facility shall be easily accessible by employees before and after duty hours and during the normal business day. The facility shall be within reasonable walking distance (1 mile) of Crystal Mall 3, 1851 South Bell Street, Arlington, VA. The Contractor shall provide a variety of exercise equipment and classes to include aerobic exercise machines, weight room, pool, aerobic classes, tennis courts, racquetball courts, and shower facilities. The Contractor shall provide numbered, individual identification cards to members at no additional cost to the government. Also, the Contractor shall provide a listing of all cards issued each month and maintain a daily sign-in log for BTA personnel. Lastly, the Contractor is required to prepare a monthly member usage report to be provided to the Contracting Officer's Representative (COR) or authorized point of contact. The memberships being purchased shall belong to the government (BTA). The Contractor shall propose a mechanism for structuring and pricing a corporate membership for BTA. Participant memberships may be terminated upon a 30 day written notice with the termination effective at the end of the following full calendar month. Any advance co-payments will be refunded to the individual upon termination on a pro rated basis. In the event that a member transfers or decides not to continue using the facility during the period of this contact the Government (BTA) shall have the right to transfer the membership from person to person at will, provided that the individual assuming the membership makes the requisite co-payment. There shall be no fee associated with such transfer. The BTA reserves the right to terminate memberships due to lack of participation by giving a two week notice to the contractor will the cancellation being effective at the end of that calendar month. The Government (BTA) will be allowed to hold PRT testing once during a 6-month period of performance at no cost to the BTA military personnel who are not members of the facility. The PRT testing time/date must be approved prior to test. The contractor may schedule quarterly on-site enrollments. INVOICING INSTRUCTIONS Invoices shall be submitted to the COR (Acceptor) as a 2-in-1 or Combo invoice via the internet using the Government Wide Area Work Flow (WAWF) Receiving/Acceptance system at https://wawf.eb.mil (ref. The Contractor shall submit a monthly member usage report with the invoice. The payment on invoices will be made only for actual number of memberships used per month at the Crystal City location(s). The Contractor shall ensure that the utilization of memberships does not exceed the estimated number listed under scope, without prior approval from the Contracting Officer. APPLICABLE REGULATIONS AND DOCUMENTS: The following references pertain to the physical fitness requirements and guidelines: DoD Directive 1010.10 Health Promotion and the American College of Sport Medicine Guidelines (ACSM) for Exercise Testing and Prescription. AR 215-1, Morale, Welfare and Recreation Activities. AR 600-63 Army Health Promotion. END OF STATEMENT OF WORK The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. The clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. The clause at 52.217-8, Option to Extend Services, applies to this acquisition. FAR Clauses may be accessed electronically at http://farsite.hill.af.mil Addenda to FAR 52.212-2 Evaluation - Commercial Items, is applicable. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Price, Past Performance and Facilities Amenities. Prices. Price will be evaluation using price analysis techniques. A single award will be made to the responsible offeror whose offer conforms to the solicitation and is most advantageous to the Government. In making the best value determination, the Government will make a comparative assessment of the offerors. Past Performance. Please submit information on your experience and/or past performance performing similar tasks/services. The offeror may provide past performance information, as follows, for consideration: •(1) A list of contracts, commercial or Government, performed within the past two years, limited to three (3) Government and three (3) commercial contracts for the same or similar service. The offeror shall provide or include a point of contact (POC) address, telephone number, an average dollar amount of the contract per annum, the period of performance and a sample listing of the services provided for under the commercial contracts. For any Government contracts, provide the Government agency, a (POC), telephone number, appropriate contract number, estimated dollar value of the contract, period of performance and a sample listing of the items provided. The Government reserves the right to limit the number of references it decides to contact. •(2) A list of any problems or discrepancies experienced within the past year for the contracts or customers reported in reference to paragraph (1) above. Include a brief description of how these problems were addressed and remedied. Facilities Amenities. Please subject a description of equipment and amenities in your facility. For example, the number of different types of treadmills, elliptical trainers, the size of any pools, walking/running tracks and health, willness and education programs your facilities offers. Please provide information on your location as BTA desires a facility with a one mile distance from the BTA offices in Arlington, VA. The BTA desires a closer facility as compared to one farther away. Offerors are to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, with their offer. Addenda to FAR 52.212-5 -- Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items. (c) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (d) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (Pub. L. 110-252, Title VI, Chapter 1 (41 U.S.C. 251 note)). The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until the funds are made available to the Contracting Officer for this contract and until the Contractor received notice of such availability, to be confirmed in writing by the Contracting Officer. The Defense Priorities and Allocations System (DPAS) rating for this requirement is DO C9. Offers are due on or before 3:00 PM EST on September 10, 2010.
