- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, VA Puget Sound Health Care System. 2. Description of Action: This document sets the justification and approval for award of a purchase order to Alliant Healthcare Products, a Service Disabled Veteran Owned Small Business (SDVOSB) concern, using other than full and open competition in accordance with the Department of Veterans Affairs IL 049-07-08. The Department of Veterans Affairs IL 049-07-08 changes the priorities for contracting preferences within VA, placing SDVOSB and VOSB first and second, respectively in satisfying VA's acquisitions requirements. 3. Description of Supplies or Services: The Universal High Torque Drill and accessories is a specialized drill set for Neurology Department to provide the best care for Veterans at Puget Sound Healthcare System and must stay consistent with associated products of Stryker Corporation already on board. 4. Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: Pursuant to the authority of 38 U.S.C. 8127 & 8128 and the Department of Veterans Affairs IL 049-07-08; and FAR Part 6-302-5. P.L. 109-461 amends 38 U.S.C. allowing the VA the unique ability to sole source directly to (SD)VOSB and IL-049-07 (Information Letter dated June 2007) - Alliant Healthcare Products, a Service Disabled Veteran Owned Small Business, of Richland, MI. has teamed up with Stryker of Kalamazoo, MI. and is the exclusive provider of these Stryker products to all Government Facilities. These items must remain consistent and compatible with other Stryker products that are already in use in Neurology, where the staff is familiar with and has been trained in its application(s). 6. Actions to Promote Competition: No actions are taken at this time to seek sources outside of statutory requirements. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is a total of $24,882.70 which is 36.27% less than $39,046.00 off of Alliant/Stryker 2010 Commercial Price List (see attached). As per (Rep) Heather Haydo stated Alliant Healthcare is in the process of trying to add these items and others to the FSS contract. The Puget Sound Healthcare has been given special pricing for some of the items, which would be a bit lower than what would be on FSS. 8. Market Survey (FAR 7.102): Based on market research this SDVOSB (Stryker Corporation partnership with Alliant Healthcare) is the sole distributor for the Government. Alliant Healthcare Products is capable of providing all the needs of Stryker Products and will provide the best value to the government. 9. Other Considerations: Not Applicable. 10. Listing of Sources that expressed, in writing, an interest in the acquisition: No sources have expressed an interest in this acquisition. 11. Statement of Actions to Overcome Barriers to Competition: No actions intended as the action is based on statutory authority for sole source; however, for future requirements for same or similar supplies, this office will, as appropriate, seek opportunities to increase competition through use of competitive procedures best suited to the circumstances of the contract action. 12.
