AMENDMENT NOTICE: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The solicitation number is SAQMMA10Q0255 and is issued as an invitation for bids (IFB), unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-44. The associated North American Industrial Classification System (NAICS) code for this procurement is 334290 with a small business size standard of 750.00 employees. This requirement is unrestricted and only qualified offerors may submit bids. The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2010-09-15 14:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com. FOB Destination shall be Multiple shipping information. Must include auto sensing, auto ranging power supply; Must include North American power cable, telephone cord, and user manual. Must include three year warranty. Use for Classified may be restricted by local policy., 200, EA; LI 002, (Brand Name or Equal to General Dynamics Part Number 1DGTDTDX01) Description: DTD CABLE SWT/vIP: Data Transfer Device (DTD) Fill cable accessory. Required to connect DTD and similar fill devices ( SDS, SKL) to the Terminal quoted in line item 001, BDI Wireline, or vIPER for initial fill. DB9 pin connector (terminal) to circular connector (DTD)., 200, EA; LI 003, (Brand Name or Equal to: General Dynamics Part Number VIPUPDC01) Description: Update Cable SWT/vIP: Software Update/Service Port cable for Terminal quoted in line item 001 and vIPER. Female DB9 to Male DB9., 200, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids. All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com. The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. These obligations do no cease upon the expiration or termination of this contract. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors, listed in descending order of importance, shall be used to evaluate offers: (i) technical capability of the item offered to meet the Government requirement; (ii) past performance; (iii) price; Technical and past performance, when combined, are significantly more important than price. (b) Removed and Reserved. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (End of Provision) (a) If an item in this solicitation is identified as brand name or equal, the purchase description reflects the characteristics and level of quality that will satisfy the Governments needs. The salient physical, functional, or performance characteristics that equal products must meet are specified in the solicitation. (b) To be considered for award, offers of equal products, including equal products of the brand name manufacturer, must (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate equal products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an equal product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) This solicitation requests Terminals use to process cryptologic information, for use by Government entities for processing certain controlled information. Executive Order 12333 United States Intelligence Agencies (as amended) gives the National Security Agency (NSA) exclusive authority to prescribe security regulations covering, among other things, transmission, handling, and distribution of communications security material. In exercise of this authority, NSA has established Requirements for Type 1 Cryptographic Products (ref NSA/CSS Policy 3-9) which applies to the terminals required by the Department. NSA further exercises its authority by acting as the exclusive authority of tested and approved units for deployment by federal government agencies for COMSEC requirements. In order to be eligible for award, the offeror must be approved by NSA to sell and deliver to Government agencies NSA-approved Type 1 Cryptographic Products, and shall provide evidence of said certification, upon request, to the requesting contracting activity. NSA does not make, by virtue of its certification, any warranty or representation regarding the quality of services provided by any vendor.
