DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, Seattle VA Medical Center 2.Description of Action: This is a request for other than full and open competition for the procurement of equipment as listed in the attached quote. 3.Description of Supplies or Services: This equipment is being obtained for the Desert Northwest Regional Amputation Center which is part of the VA National Amputation System of Care program and located in the VA Puget Sound Health Care System. All of the equipment will be used directly to accomplish the mission of the Amputation System of Care which is to be the provider of choice for Veterans with amputations. All of the equipment being ordered will be used for the direct clinical care of the amputee population for either prosthetic fabrication, rehabilitation training, or telehealth services. The funding for the equipment which is being ordered has already been approved by the National Amputation System of Care authority. (Approval Documentation attached) 4.Statutory Authority: ( x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: We propose the use of Ohio Willow Wood as the contract source to obtain the requested equipment for the following reasons. Ohio Willow Wood is a reputable company with a long history of manufacturing equipment utilized in the fabrication of prosthetic components and sockets. The providers requesting the equipment have been in contract with other providers across the country that are currently utilizing the requested equipment and the contract source, Ohio Willow Wood, comes highly recommended from current users of the equipment. Some of the providers requesting this equipment also have experience using the requested equipment in other settings. To our knowledge there are only 2 other manufacturers / contract sources that provide similar equipment. The requesting providers have experience with one of these sources, Biosculpter. The similar product from Bioscuplter was actually purchased and tested in the past by the requesting providers. The Bioscuplter system was found to be unsatisfactory to the requesting providers and this equipment was subsequently returned. The other potential source, Vurum Research, is located in Canada and their equipment is manufactured in Canada. The requesting providers are not comfortable with this source secondary to the fact that the company is located outside of the United States and because the equipment from this source is not widely used in the United States. The requesting providers are not comfortable with the custom service that would be provided for the equipment from this source, but the requesting providers have had good experience in the past with the customer service provided by the preferred contract source, Ohio Willow Wood. In addition, the pricing for the requested equipment from the preferred contract source is better or competitive with the pricing from the other potential contract sources. 6.Actions to Promote Competition: The customer stated that similar sources were used in the past. Biosculpter was not able to meet the customer's needs, which prompted the customer to write this sole source justification for the OMEGA Tracer CAD system. Both the contracting officer and the customer will continue to consider alternative sources in the future. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 63,240.00. The contracting officer contacted other VA facilities to determine price reasonableness. VAMC-Mufreesboro purchased OMEGA Tracer Software for $139,108.00 (FAR 13.106-3(a)(2)(ii). The price quoted to us is consistent with the independent Government estimate (FAR 13.106-3(a)(2)(vi)). 8.Market Survey (FAR 10): Please refer to the justification included in Section 5 above. The requesting providers have extensive experience in the area of amputee rehabilitation and prosthetic fabrication. The requesting providers are very familiar with the various contract sources in the field and the reputation of these contract sources. The requesting providers have researched the potential contract sources well as described in section 5. The requesting providers have also had significant experience with the preferred contract sources and have also been in communication / discussion with other providers across the country who have also had experience with the preferred contract source. 9.Other Considerations: The contracting officer contacted Ohio Willow Wood to determine whether they were an exclusive provider of the OMEGA Tracer CAD system. The OMEGA Scanner and Carver are sold exclusively by Ohio Willow Wood (FAR 6.302-1(b)(1)(i)). Several of the OMEGA products are also manufactured directly from Ohio Willow Wood. Thus, they are the only source able to provide this equipment. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: N/A 11.Statement of Actions to Overcome Barriers to Competition: Both the customer and the contracting department will consider alternative products as they become available. The customer tried a similar product from Biosculpter in the past. This product was not conducive to fulfill the customer's needs. As of the time of this writing, only one additional known source makes a similar product. This source is a foreign entity.
