GENERAL SERVICES ADMINISTRATION Justification for Other than Full and Open Competition Real Estate Acquisition Division/South Branch FBI Aquia I Lease Renewal Stafford, VA Lease Number: LVA09364 Building Number: VA0419 Project Number: 9VA2322 1. Justification for other than full and open competition: To exercise a five (5) year renewal option at the current location, Aquia I Commerce Center, 2721 Jefferson Davis Highway, Stafford, VA. The lease renewal will be for 31,665 ANSI/BOMA Office Area (ABOA) square feet/ 34,111 Rentable (RSF) square feet. 2. Nature and/or description of the action being approved. FBI <REDACTED> currently occupies 31,665 ANSI/BOMA Office Area (ABOA) square feet or 34,111 rentable square feet (RSF) of office space under Lease Number GS-03B-09364. The lease term is January 30, 2001 through January 20, 2011. The Lessor submitted a five (5) year renewal option. The current lease was negotiated through GSA's National Capital Region (NCR). After a review of their leases, NCR discovered that this lease currently resides in the Mid-Atlantic Region. The lease was officially transferred to Region 3 on March 1, 2009. Since that time, GSA has been working with FBI <REDACTED> to finalize their future requirements for this lease as well as the adjacent lease facility, Aquia II. The Aquia II lease discussions took precedent because of the impending lease expiration date of December 14, 2009. When GSA had finished negotiating the seven renewal option for Aquia II, the Lessor proposed a five year renewal option for Aquia I, which would allow both leases to expire in the same calendar year. In addition, FBI <REDACTED> submitted a program of requirements that requested the Lessor to verify if the current building met FBI current building standards as well as requesting the Lessor to make several security upgrades and standard alterations to the building that would be paid for through an RWA. GSA is working with FBI <REDACTED> and the Lessor on this project. An acquisition plan has already been submitted for this project. 3. Description of the supplies or services required. GSA will exercise a five year renewal option at the current location of Aquia I Commerce Center, 2721 Jefferson Davis Highway, Stafford, VA. The FBI <REDACTED> occupies 31,665 ANSI/BOMA Office Area square feet or 34,111 rentable square feet of space at the above referenced location. The lease renewal will expire January 20, 2016. All other terms and conditions of the lease will apply including the ninety days notice to terminate the lease. The lease renewal rate has been negotiated with the Lessor. <REDACTED> 4. Identification of the statutory authority 41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. At this time, there are no buildings in the Stafford County area that can meet the agency's square footage requirements of 31,665 ABOA/ 34,111 RSF. In addition, the FBI <REDACTED> must be co-located with the adjacent facility at Aquia II Commerce Center, 2723 Jefferson Davis Highway, Stafford, VA. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable An advertisement was placed on fedbizzopps on August 4, 2010 and ran through August 13, 2010. The ad was posted for one week. There were no responses to the advertisement that met the agency's delineated area and office space requirement. A survey was conducted on Co-Star for available space in Stafford County. Information regarding this survey is in the attached "Market Analysis". 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The rental rate was found to be fair and reasonable as described in the attached procurement sensitive document, "Market Analysis". 8. Description of the market research conducted A market survey was not conducted, however, GSA was able to utilize co-star to obtain the rates of comparable office buildings in the Stafford market. This information as well as the cost benefit analysis can be found in the attached document "Market Analysis". 9. Other facts supporting the use of other than full and open competition <REDACTED> FBI <REDACTED> is very satisfied with the Lessor and their responsiveness. The building received 80% overall satisfaction rating in 2008's Customer Satisfaction Survey. 10. List of any sources that expressed in writing an interest in the acquisition GSA did not receive any responses to the advertisement placed in fedbizzopps that met the agency's delineated area or office space requirement. 11. Statement of actions the agency may take to remove or overcome any barriers to competition <REDACTED> I hereby certify that the above information is accurate and complete to the best of my knowledge.
