- On September 15, 2010 the Defense Threat Reduction Agency (DTRA) awarded, without competition, a Cost Reimbursement(CR)/Research and Development (R&D) Contract to The President and Fellows of Middlebury College (Middlebury College). The purpose of the contract is to conduct analytical research and development in the performance of nonproliferation studies in the area of weapons of mass destruction. The work will be performed by the Monterey Institute for International Studies (MIIS), a graduate school of Middlebury College. Pursuant to FY09 and FY10 Appropriations Acts, Congress authorized a congressional earmark to MIIS specifically for the performance of nonproliferation studies. As a result of the congressional earmark, a Justification for Other Than full and Open Competition was not required for this noncompetitive award. Per FAR 6.302-5(2)(II): "Justification for Other than Full and Open Competition need not be provided for when: Contracts [are awarded] under (a) (2)(i) of this subsection when the statute expressly requires that the procurement be made from a specified source." Additionally, the contracting officer determined that the use of a CR type contract is likely to be less costly to the Government than any other method. Specifically, the nature of the work required cannot be described and identified with reasonably enough precision to derive a realistic and fair fixed price for performance costs. Since the work requirements cannot be defined precisely and there are significant uncertainties involved in contractor performance, the use of a contract with a fixed price arrangement was not appropriate for this acquisition.
