Description
Justification For Other Than Full & Open Competition (REF: FAR 6.303) 1.Identification of Agency and Contracting Activity VISN 15 Contracting Section, General Services Team (10N15-90) 2.Nature/Description of Action SDVOSB Sole-Source Service Contract, 3.Description of Supplies/Services 3rd party construction oversight, project management and onsite air sampling at Jefferson Barracks VAMC campus, Saint Louis Missouri. 4.Identification of Statutory Authority The requirement is to be procured under Public Law 109-461, as codified at 38 U.S.C. § § 8127 and 8128 and in accordance with FAR 6.302-5 (Authorized or Required by Statute). Furthermore, the requirement is to be procured in accordance with Veterans Affairs Acquisition Regulations (VAAR) 819.7007 (Sole Source Awards to Service Disabled Veteran Owned Small Business Concerns). 5.Rationale in support of citation in Paragraph 4 above: Pursuant to Public Law 109-461, and as codified in 38 U.S.C. §8127(b), contracting officers may use noncompetitive procedures (including sole source awards) in acquisitions for an amount less than the simplified acquisition threshold to make awards to Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and Veteran-Owned Small Businesses (VOSB). Pursuant to VAAR 819.7007, a contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. As stated in VAAR 819.7007(b), the contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer and a determination that only one SDVOSB concern is available to meet the requirement is not required. The vendor, Riverfront Safety and Health LC DBA Riverfront Environmental, is a registered SDVOSB, as verified at http://www.vetbiz.gov. The above acquisition will be negotiated with: Riverfront Safety and Health LC DBA Riverfront Environmental 1139 Olive St. DTE 300 Saint Louis, Missouri POC: Justin Rhyneer PH: 314-436-9492 6.Determination of a Fair and Reasonable Cost The Contracting Officer determines that the anticipated cost to the government will be fair and reasonable as compared to the IGE submitted by the Requiring Activity Note: The resulting Price Negotiation Memorandum (PNM) will document this for the contract file. 7.Description of market survey and any interested sources. If no market survey was conducted, state the reason. The firm that is selected for the SDVOSB sole-source negotiated award is Riverfront Safety and Health LC DBA Riverfront Environmental of Saint Louis Missouri. This firm has successfully provided services of this type to facilities in VISN 15. The Contracting Officer has confirmed the contractor's experience and capability. 8.Additional Support for the use of other than full and open competition: a. Explanation of why technical data, specifications, engineering descriptions, statement of work or purchase descriptions suitable for full open and competition have not been developed or are not available: NA b. When the sole source exception is used in the case of a follow-on acquisition, provide an estimate of the cost that would be duplicated and describe how the estimate was derived if the contract is awarded to other than the incumbent: N/A c. When the urgency exception is cited provide the data, estimate of cost or other rationale as to the extent of harm to the government if the contract is not awarded expediently: N/A 10.
