Description
The EPA has a need for a contractor to provide technical and analytical support to the U.S. Environmental Protection Agency (EPA), Office of Air and Radiation (OAR), Office of Transportation and Air Quality (OTAQ), Compliance and Innovative Strategies Division (CISD) and other divisions within OTAQ. CISD has the primary responsibility for implementing certification and compliance monitoring for programs for mobile source standards and rules promulgated under Title II of the Clean Air Act Amendments of November 15, 1990 (CAAA). OTAQ and CISD also pursue voluntary programs to encourage retrofits of existing vehicles and equipment. CISD routinely supports other divisions engaged in activities including regulation development and engine/vehicle emission test programs requiring analysis and support. CISD is responsible for quantifying and reporting fuel economy results from certain motor vehicles sold in the U.S. The EPA is seeking a contractor to: (1) provide economic, environmental, statistical, financial, and evaluative analysis support, (2) provide technical and engineering analysis support, (3) provide communication, outreach, guidance, and regulatory program support, (4) provide web, computer system, and database support and development, and (5) provide support for implementation and compliance monitoring of air pollution regulations and programmatic requirements. It is anticipated that the contract will be issued on a Cost Plus Fixed Fee (CPFF) Level of Effort (LOE) contract with a twelve-month base term followed by four (4) consecutive one (1) year optional periods, for a total potential performance period of five (5) years. The base level of effort for each term will consist of 35,000 direct labor hours. Each performance period will contain options for additional quantities of 15,000 LOE hours which brings the maximum total potential on the contract to 250,00 direct labor hours over five (5) years Significant potential exists for conflicts of interest (COI) under this procurement. Therefore, it is considered in the best interest of the Government to exclude from consideration for award, as prime contractor or subcontractor, all motor vehicle manufacturers, fuels and/or fuel additives producers, all entities in the field of emission control/reduction, energy efficiency and/or energy technologies, as well as point source emitters of nitrogen oxides (NOx), sulfer dioxide (SO2), exhaust and evaporative hydrocarbons (HC), carbon monoxide (CO), carbon dioxide (CO2), air toxics, and/or particulate matter (PM). The solicitation will contain the following provision, ?Industries Prohibited From Being Considered for Award. The text of this clause will be as follows: Whereas this procurement requires that the contractor provide support for certification, compliance, monitoring and technology assessment activities directly affecting the motor vehicle manufacturers, motor vehicle engine manufacturers, nonroad vehicle and nonroad engine manufacturers, fuels and/or fuel additives producers, firms in the field of emission control/reduction, energy efficiency and/or energy technologies, as well as point source emitters of nitrogen oxides (NOx), sulfur dioxide (SO2), exhaust and evaporative hydrocarbons (HC), carbon monoxide (CO), carbon dioxide (CO2), air toxics, and/or particulate matter (PM), the Contracting Officer has determined that an Organizational Conflict of Interest (OCOI) will result. Therefore, any motor vehicle manufacturers, motor vehicle engine manufacturers, nonroad vehicle and nonroad engine manufacturers, fuels and/or fuel additives producers, firms in the field of emission control/reduction, energy efficiency and/or energy technologies, as well as point source emitters of nitrogen oxides (NOx), sulfur dioxide (SO2), exhaust and evaporative hydrocarbons (HC), carbon dioxide (CO2), air toxics, and/or particulate matter (PM) will be considered ineligible for award of any contract resulting from this solicitation. The specific determination whether any other offeror is to be considered ineligible for award will be made by the Agency on a case-by-case basis. The solicitation and resulting contract shall also contain the clause, Limitation on Future Contracting. The text of this clause will track with Limitation of Future Contracting, Alternative V (Headquarters Support), EPAAR 1552.209-74 (April 2004), except for paragraph (c). Paragraph (c) of the clause shall read as follows: Paragraph c: Unless prior written approval is obtained from the EPA Contracting Officer, the contractor agrees not to enter into a contract with or represent any party, other than EPA, with respect to the specific activities performed under this contract. Specifically, the contractor is not to enter into contracts or represent any motor vehicle manufacturers, motor vehicle engine manufacturers, nonroad vehicle and nonroad engine manufacturers, fuels and/or fuel additives producers, entities in the field of emission control/reduction, energy efficiency and/or energy technologies, as well as point source emitters of nitrogen oxides (NOx), sulfur dioxide (SO2), exhaust and evaporative hydrocarbons (HC), carbon monoxide (CO), carbon dioxide (CO2), air toxics, and/or particulate matter (PM) involving matters related to the contractor?s specific activities under this contract. These restrictions apply during the life of the contact. Interested parties are advised that EPAAR provisions (EPAAR 1552.209-70 and 1552.209-72) requiring the offeror to certify that it is unaware of any potential Conflict of Interest or to disclose any potential Conflict of Interest of which it is aware, shall be required. Therefore, offerors will be required to submit a COI plan which identified the projects they are working for entities excluded from consideration for award and explain how potential or actual OCOI can be either avoided, neutralized, or mitigated. The applicable NAICS code is 541620 (Environmental Consulting Services) with a size standard of $7 million. The anticipated solicitation release date is expected to be posted on or about late September 2010 and the close date shall be approximately 30 days thereafter. The solicitation will be issued on a full and open competitive basis with no small business set-aside. Interested parties are expected to download the solicitation and any subsequent amendments from the website and to monitor the status of the RFP. All responsible sources may submit a proposal which will be considered by the EPA. Contract award will be made in accordance with FAR part 15-Contracting by Negotiation.
