Description
The National Library of Medicine (NLM) intends to negotiate on a sole source basis with Scientists Center for Animal Welfare (SCAW) at 7833 WALKER DRIVE, SUITE 410, Greenbelt, MD 20770-3229 to acquire conference support services to support the Institutional Animal Care and Use Committee (IACUC) Winter Conference required for December 6 - 7, 2010 and up to three IACUC training workshops per year on behalf of the National Institutes of Health under the authority 41 U.S.C. 253 (c) (1) and FAR 6.302-1(b)(1). SCAW has been identified as the only vendor eligible to participate in the annual IACUC training workshops during the month of December to develop educational content of the workshops to provide training focusing on advanced topics (e.g., protocol review) for Institutional Animal Care and Use Committee (IACUC) members with specific knowledge of the PHS Policy on Humane Care and Use of Laboratory Animals. The agreement, ‘Winter Conferences and IACUC Training Workshops " is available only through the SCAW. The agreement will be acquired in accordance with the Federal Acquisition Regulation (FAR) Part 12 - Acquisition of Commercial Items and FAR Part 13 - Simplified Acquisition Procedures. The North American Industry Classification System code for this acquisition is 541990. This notice of intent is not a Request for competitive Quotations (RFQ), nor is an RFQ available. Vendors may identify in writing their interest and capability in response to this requirement or submit a proposal. This notice of intent is not a request for competitive proposals. However all responses received no later than the closing date of this announcement will be considered by the government. A determination by the government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Purpose The purpose of this procurement is to acquire conference planning and support for the annual IACUC Winter Conference scheduled for December 6 - 7, 2010 and up to three IACUC Training Workshops per year. Background The Office of Laboratory Animal Welfare (OLAW), OER, NIH, is responsible for the general administration and implementation of the PHS Policy on Humane Care and Use of Laboratory Animals, and does this through a variety of educational and assurance mechanisms. One such mechanism is the support of educational workshops and conferences. There is a particular need for basic training of incoming Institutional Animal Care and Use Committee (IACUC) members in the practical implementation of the PHS Policy and in advanced and complex topics affecting IACUCs, and for educational opportunities that address how to achieve and coordinate compliance with the major oversight systems, including OLAW/PHS. The SCAW Winter Conference is a two-day educational conference that includes presentations and multiple breakout sessions addressing various challenges for institutions, timely topics of interest, and opportunity for discussion. Held annually, each Winter Conference focuses on a specific topic. For example, the focus for the 2010 Winter Conference is "The Evolution of Your IACUC: Promoting Science and Compliance" and will include topics such as ethics in animal research, IACUC administration, and protocol review. Each of the IACUC Training Workshops will consist of a one-day program focusing on advanced and complex topics of interest to IACUC members. The topics include advanced protocol review; such as what to look for in a protocol that includes relieved and/or unrelieved pain and distress, how to recognize and evaluate the level of pain and distress, appropriate end points, and special environmental conditions required because of potential pain and/or distress. Each Workshop will provide opportunities for small discussion groups, and sharing of information among the participants concerning issues and controversies involving compliance with federal laws and regulations in research activities involving animals. Specific Tasks Independently, and not as an agent of the Government, the vendor will present an annual Winter Conference and up to three IACUC-Advanced Workshops per year. The vendor will make a concerted effort to solicit appropriate participation of women, racial/ethnic minorities and persons with disabilities, and other individuals who have been traditionally underrepresented in science, in accord with the NIH Policy "Guidelines on Inclusion of Women, Minorities, and Persons with Disabilities in NIH Sponsored Intramural and Extramural Scientific Meetings and Conferences." (http://grants.nih.gov/grants/guide/notice-files/not95-123.html) The Conference and Workshops will be held at accessible sites, as outlined by section 504 of the Rehabilitation Act of 1973 and, as applicable, the Americans with Disabilities Act of 1990 that permits convenient accessibility for attendees. Participants with disabilities will be permitted to voluntarily identify any special needs. The Conference and Workshops will be open to all individuals completing the appropriate registration form and paying the required registration fee, until such time as physical capacity for the sessions is reached. The vendor is to develop educational content of the workshops to provide training focusing on advanced topics (e.g., protocol review) for Institutional Animal Care and Use Committee (IACUC) members. This requires background expertise and knowledge of the laws, regulations and policies that govern the humane care and use of laboratory animals. Specific knowledge of the PHS Policy on Humane Care and Use of Laboratory Animals is required. The programs will focus on topics of interest to IACUC members with a particular emphasis on the requirements of the PHS Policy. They will provide a basic yet comprehensive overview of the laws, regulations, and policies that govern the humane care and use of laboratory animals supplemented with examples and possible approaches for successful and effective administration. There will be opportunities for participants to consider and discuss complex challenges to complying with PHS Policy. Government Furnished Equipment (GFE)/ Government Furnished Information (GFI) No government equipment will be furnished. The only government furnished information may be the names and addresses of the IACUC Chairs at institutions with PHS Animal Welfare Assurances, which may be provided for purposes of publicizing the Conference and Workshops and may not be used by the vendor for any other purpose. Period of Performance The period of performance shall be for 12-months from the date of award. Labor Hours and Travel Not applicable, this is a firm fixed price contract. Inspection and Acceptance Requirements The project officer or a designated federal employee of OLAW will attend and participate in these meetings, will attest that the deliverables are acceptable to the government, and will represent the Government for the purposes of the purchase order. Confidentiality of Information The Government has determined that any information/data that the vendor will be provided during the performance of the contract will not be of a sensitive nature. (See section on Government Furnished Information above.) Sensitive Information Protection Not applicable. The Government has determined that any information/data that the Contractor will be provided during the performance of the contract will not be of a sensitive nature. Nonpersonal Services (1) As stated in the Federal Register, Volume 57, No. 190, page 45096, dated September 30, 1992, Policy Letter on Inherently Governmental Functions, no personal services shall be performed under this contract. All work requirements shall flow only from the Project Officer to the Contractor's Project Manager. No Contractor employee will be directly supervised by the Government. All individual employee assignments, and daily work direction, shall be given by the applicable employee supervisor. If the Contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any Contractor employee, the Contractor shall promptly notify the Contracting Officer of this communication or action. (2) The Contractor shall not perform any inherently Governmental actions under this contract. No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative. No Contractor employee shall state orally or in writing at any time that he or she is acting on behalf of the Government. In all communications with third parties in connection with this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work. In all communications with other Government contractors in connection with this contract, the Contractor employee shall state that he/she has no authority to, in any way, change the contract and that if the other contractor believes this communication to be a direction to change their contract, they should notify the Contracting Officer for that contract and not carry out the direction until a clarification (3) The contractor shall insure that all of its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government's rights in any way under the other provisions of the contract, including those related to the Government's right to inspect and accept the services to be performed under this contract. The substance of this article shall be included in all subcontracts at any tier. By submitting a quote, the vendor will be self-certifying that neither the requestor nor the principal corporate officials and owners are currently suspended, debarred, or otherwise ineligible to receive contracts from any federal agency. Failure to do so may represent grounds for refusing to accept the quote. Through its submission, the vendor acknowledges the requirement that a prospective awardee must be registered in the Central Contractor Registration (CCR) database prior to award, during performance and through final payment of any contract resulting from this solicitation.
