- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (SOLE OR SINGLE SOURCE - LESS THAN $100,000) In accordance with the authority granted under FAR Part 13, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: Requesting Agency: USDA/GIPSA/FGIS League City Field Office 1025 East Main Street #104 League City, Texas 77573 Contracting Activity: USDA, APHIS, MRPBS, ASD Minneapolis Procurement Branch Butler Square, Fifth Floor 100 North 6th Street Minneapolis, MN 55403 NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: Purchase of Infratec 1241 Basic 2 (PART # 12410222)used for obtaining protein results, using the USDA, FGIS approved instrument. This instrument is also used as a NIR Infrared method to obtained protein results from grain. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS): (See attached quote from Vendor) The estimated price of this requirement is $28,985.07. This estimate is based upon Current quote received from the FOSS North American Company dated 7/20/2010. IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING NONCOMPETITIVE ACQUISITIONS: The statutory authority is 41 U.S.C. 253( c )(1) OR 253( c )(2) FAR 6.302-1 The property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: In order to provide the highest quality service, GIPSA has standardized its methods and equipment. Only these specific methods and equipment are to be used. The Infratec 1241 Is a highly specialized piece of equipment already previously purchased and in use at the GIPSA League City, Texas facility for several years. This item can be found on the official GIPSA Approved Equipment List, and is referenced several times in the Official GIPSA Near-Infrared Transmittance Handbook (NIRT) See attached. For several years, producers of specialty varieties of corn grown for a particular end-use expressed an interest and need to analyze corn for oil, protein and starch. A 1996/97 quality report estimated that approximately 3.2 to 3.8 percent of the U.S. harvested acreage were specialty varieties. Future crop production estimates identified High-Oil Corn (HOC) as the fastest growing specialty corn in the United States. By the year 2000, production of HOC is expected to reach 3 million acres and represent a significant part of the specialty varieties produced and traded in the marketplace. HOC is used primarily by livestock feeders to replace animal fat previously added to livestock rations and to help animals gain weight more rapidly. Due to the anticipated increase in specialty corn production and market demand for reliable official testing procedures, GIPSA offers protein, oil, and starch testing as an official testing service. This lets GIPSA provide the corn industry with accurate results that the industry can rely on to negotiate price while providing the best information possible to determine end-product yield. The testing service is provided by GIPSA and official agencies equipped with standardized NIRT instruments. The NIRT calibrations were developed to automatically provide protein, oil, and starch percentages on a dry matter basis. (source - http://www.mindfully.org/Pesticide/OQAS-USDA-GIPSA.htm) A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE, PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES: None at this time. Item listed on quote is a replacement for equipment already purchased and in use at the GIPSA League City, Texas facility for several years. Competition would not be cost effective, since the Infratec 1241 listed on the official GIPSA parts list is the only specified model that will satisfy the agency's needs. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE, AND THE BASIS FORTHAT DETERMINATION: Contracting Officer was unable to determine cost to be fair and reasonable for the following reasons: • On-line research for pricing on similar items. - none found • Unable to locate any previous USDA orders for the Infratec 1241 A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (FAR PART 10) AND THE RESULTS, OR AN EXPLANATION OF THE REASON MARKET RESEARCH WAS NOT PERFORMED: • On-line research for pricing on similar items. - none found • Unable to locate any previous USDA orders for the Infratec 1241 ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION - FAR 6.303-2(a)(9): The USDA will not take any action to overcome barriers to competition at this time due to the fact that the current requirement for a Infratec 1241 is a replacement for equipment already purchased and in use at the GIPSA League City, Texas facility for several years. Competition would not be time worthy or cost effective because the Infratec 1241 is listed on the GIPSA approved equipment list providing uniformity and continuity of use in conjunction with current methods for obtaining protein results from grain A STATEMENT OF THE ACTIONS, IF ANY. THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED: None at this time. Competition would not be time worthy or cost effective because this item is listed on the GIPSA approved equipment list providing uniformity and continuity of use in conjunction current methods for obtaining protein results from grain, using the USDA, FGIS currently approved instrument.
